ABSTRACT: The Master’s memoir «Murabaha Contract in Algerian Legislation" examines the concept of Murabaha as an Islamic financing tool, and its application within the Algerian legal system, The research is divided into two main chapters: Chapter One: The Theoretical Framework of the Murabaha Contract; This chapter explains the essence of the Murabaha contract, drawing upon its definition from Islamic jurisprudence, law, and economics, emphasizing its legitimacy under Islamic Sharia, it also addresses the contract's fundamental elements and conditions, distinguishing it from other financing formulas such as conventional sales and interest-based loans, and highlighting its significance in the Islamic financial system. La recherche est divisée en deux chapitres principaux : Chapitre premier : Le cadre théorique du contrat Mourabaha ; Ce chapitre explique l'essence du contrat Murabaha, en s'appuyant sur sa définition de la jurisprudence, du droit et de l'économie islamiques, en soulignant sa légitimité en vertu de la charia islamique. Il aborde également les éléments et conditions fondamentaux du contrat, le distinguant des autres formules de financement telles que les ventes conventionnelles. et les prêts à taux d'intérêt, et soulignant son importance dans le système financier islamique.
