Summary : The constitutional amendment of 2020 marked a qualitative shift in the structure of constitutional judiciary by establishing the Constitutional Court and expanding notification mechanisms. It transitioned from exclusive direct notification to enshrining indirect notification through the mechanism of raising unconstitutionality، which grants litigants the right to invoke subsequent constitutional review before judicial authorities. This expansion reinforces the principle of participatory oversight and establishes the supremacy of the constitution as a normative référence for légal texts، thereby imparting an advanced functional character to the role of the Constitutional Court، making it a tool for protecting rights and ensuring legal security within a flexible and interactive constitutional system. ............................. الملخص: شهدت التعديلات الدستورية لسنة 2020 نقلة نوعية في بنية القضاء الدستوري، من خلال استحداث المحكمة الدستورية وتوسيع آليات الإخطار، فقد تم الانتقال من الإخطار الحصري المباشر إلى تكريس الإخطار غير المباشر عبر آلية الدفع بعدم الدستورية،التي تمنح المتقاضين حق إثارة الرقابة الدستورية البعدية أمام الجهات القضائية ،هذا التوسيع يعزز مبدأ الرقابة التشاركية ،ويُكرّس سمو الدستور كمرجعية معيارية للنصوص القانونية ،ممايُضفي طابعًا وظيفيًا متقدمًا على دور المحكمة الدستورية ،ويجعلها أداة لحماية الحقوق وضمان الأمن القانوني ضمن نظام دستوري مرن وتفاعلي. ........................ Résumée Les amendements constitutionnels de 2020 ont marqué une transformation qualitative de la structure du pouvoir judiciaire constitutionnel, avec la création de la Cour constitutionnelle et l'élargissement des mécanismes de notification. Le passage de la notification directe exclusive à la notification indirecte par le biais du mécanisme de l'exception d'inconstitutionnalité, qui confère aux justiciables le droit de saisir les instances judiciaires pour un contrôle post-constitutionnel. Cet élargissement renforce le principe de contrôle participatif et consacre la suprématie de la Constitution comme référence normative pour les textes juridiques.
