سلطة الوالي في الحلول على ضوء التشريع الجزائري

Abstract

Abstract : The Algerian legislation has granted the governor the authority of intervention, which is of great importance in the Algerian administrative system, enabling him to intervene to correct administrative work and ensure the functioning of public facilities. This authority is manifested in the governor's power to dissolve local authorities, namely municipalities, specifically the Municipal People's Council and its president. The authority of intervention appears in two forms: first, over the Municipal People's Council on the administrative side, and second, on the financial side concerning the president of the Municipal People's Council. As a result, the governor's interventions have legal implications. .......................... الملخص: تشكل الهيئة الإدارية على مستوى الولاية والتي يرأسها الوالي ركيزة أساسية في منظومة الإدارة المحلية ونظرا للحساسية البالغة لمنصبه فقد منح له القانون جملة من الحقوق والواجبات وأخضعه لشروط معينة لتولي منصبه وأساليب مختلفة لإنهاء مهامه و صلاحيات واسعة لضمان حسن سير العمل وتحقيق التنمية المحلية، وتتنوع مهام الوالي لتشمل جوانب مزدوجة فهو من ناحية ممثل السلطة المركزية على مستوى الولاية ومن ناحية أخرى هو المسؤول الأول عن تلبية احتياجات المواطنين وتوفير الخدمات الضرورية لهم. لقد خول التشريع الجزائري للوالي سلطة الحلول والتي تكتسب أهمية بالغة في النظام الإداري الجزائري، حيث تمكنه من التدخل لتصحيح العمل الإداري وضمان سير المرفق العام وتتمثل هذه السلطة في صلاحية حلول الوالي محل الجماعات المحلية ألا وهي البلدية وبالتحديد المجلس الشعبي البلدي ورئيسه، تظهر سلطة الحلول في شكلين أولا على المجلس الشعبي البلدي في الجانب الإداري وثانيا في الجانب المالي محل رئيس المجلس الشعبي البلدي ويترتب بذلك على حلول الوالي آثار قانونية. .............................. Résumé : La législation algérienne a accordé au gouverneur l’autorité d’intervention, ce qui est d’une grande importance dans le système administratif algérien, lui permettant d’intervenir pour corriger le travail administratif et assurer le fonctionnement des installations publiques. Ce pouvoir se manifeste dans le pouvoir du gouverneur de dissoudre les autorités locales, à savoir les municipalités, en particulier le Conseil populaire municipal et son président. L’autorité d’intervention se présente sous deux formes : d’une part, sur le Conseil Populaire Municipal côté administratif, et d’autre part, sur le côté financier concernant le président du Conseil Populaire Municipal. Par conséquent, les interventions du gouverneur ont des répercussions juridiques.
