حجية القرائن القضائية في الإثبات في النظام القانوني الجزائري

Abstract

Abstract : The issue of judicial evidence is of great importance, although it is indirect evidence in proof. It still has an important role in proving the facts. It may represent evidence that exists on its own in the process of proof, on which the judge builds a ruling. It may also constitute corroborating evidence for one of the other pieces of evidence. Therefore, we have devoted this research to studying the nature of judicial evidence and its role in proof in the Algerian legal system. We divided the research into two chapters, and we devoted the first chapter to studying the nature of judicial evidence and the legitimacy of taking it as evidence. We divided this chapter into three sections, the first devoted to defining judicial evidence and distinguishing it from others that are similar, the second to the characteristics and types of judicial evidence, and the third to clarifying legal evidence for taking judicial evidence. As for the second chapter, We divided it into three sections: the first concerns the role of judicial evidence in proof before the administrative judiciary, the second to the role of judicial evidence in proof before the criminal judiciary, and the third to the role of judicial evidence in proof before the administrative judiciary. ........................... ملخص: يكتسي موضوع القرائن القضائية أهمية كبيرة رغم كونها دليل غير مباشر في الاثبات يبقى لها دور مهم في اثبات الحقائق ، فقد تمثل دليل قائم بحد ذاته في عملية الاثبات ، فيبني على اساسها القاضي حكمة، كما قد تشكل دليل معزز لإحدى أدلة الاثبات الأخرى. ولذلك فقد قمنا بتخصيص هذا البحث لدراسة ماهية القرائن القضائية ودورها في الاثبات في النظام القانوني الجزائري. وقد قمنا بتقسيم البحث إلى فصلين وخصصنا الفصل الأول لدراسة ماهية القرائن القضائية ومشروعية الأخذ بها الإثبات وقسمنا هذا الفصل الى ثلاث مباحث الاول خصص لتعريف القرائن القضائية وتمييزها عن غيرها مما يشبها والثاني لخصائص القرائن القضائية وأنواعها والثالث لتوضيح أدلة مشروعية لأخذ بالقرائن القضائية ، اما الفصل الثاني فقد قمنا بتقسيمة إلى ثلاث مباحث الأول يخص دور القرائن القضائية في الإثبات أمام القضاء الإداري والثاني لدور القرائن القضائية في الإثبات أمام القضاء الجزائي والثالث لدور القرائن القضائية في الإثبات أمام القضاء الإداري . .............................. Résumé La question de la preuve judiciaire est d'une grande importance, même si elle constitue une preuve indirecte. Elle joue néanmoins un rôle important dans la preuve des faits. Elle peut représenter une preuve qui existe en elle-même dans le processus de preuve, sur laquelle le juge construit une preuve. Il peut également constituer une preuve corroborante pour l’un des autres éléments de preuve. C'est pourquoi nous avons consacré cette recherche à étudier la nature de la preuve judiciaire et son rôle dans la preuve dans le système judiciaire algérien. Nous avons divisé la recherche en deux chapitres, et nous avons consacré le premier chapitre à l'étude de la nature de la preuve judiciaire et de la légitimité de la considérer comme preuve. Nous avons divisé ce chapitre en trois sections, la première étant consacrée à la définition de la preuve judiciaire et à sa distinction des autres. qui sont similaires, la seconde aux caractéristiques et aux types de preuves judiciaires, et la troisième à la clarification des preuves juridiques pour l'obtention de preuves judiciaires. Quant au deuxième chapitre, nous l'avons divisé en trois sections : la première concerne le rôle de la preuve judiciaire dans la preuve. devant la justice administrative, la seconde au rôle de la preuve judiciaire dans la preuve devant la justice pénale, et la troisième au rôle de la preuve judiciaire dans la preuve devant la justice administrative.
