المحاكمة عن بعد كآلية لعصرنة قطاع العدالة في الجزائر

Abstract

Summary of the study: This study aims to present Algeria’s experience in the reform of the judicial system by exploiting the scientific and technological development that the world has experienced recently. In particular the technique of the remote trial, all countries have unanimously agreed to apply it because of its advantages to facilitate remote litigation proceedings, because the main result of the study confirms that the effects of this reform have been clear and have resulted in the qualitative improvement of judgments rendered by justice and the efficiency of the trial while preserving the rights and freedoms of citizens ........................... ملخص الدراسة تهدف هذه الدراسة إلى عرض تجربة الجزائر في إصلاح المنظومة القضائية باستغلال التطور العلمي والتكنولوجي الذي عرفه العالم مؤخرا، حيث عملت على إعادة بناء مرفق العدالة من هيكلة الأجهزة القضائية والآليات التنظيمية والتشريعية والتقنية، وحاولنا في هذه المذكرة عرض الطرق والأساليب جميع والوسائل التي تم الاعتماد عليها لتطوير الخدمة القضائية خاصة تقنية المحاكمة عن بعد، أجمعت . الدول على تطبيقها لما فيها من مزايا لتسهيل إجراءات التقاضي عن بعد، حيث أن النتيجة الرئيسية للدراسة تؤكد أن آثار هذا الإصلاح كانت واضحة ويعكسها التحسن النوعي للأحكام التي تصدرها العدالة وتحقيق فعالية المحاكمة من خلال حفظ حقوق وحريات المواطنين.

Résumé de l'étude : Cette étude vise à présenter l'expérience de l'Algérie en matière de réforme du système judiciaire en exploitant le développement scientifique et technologique que le monde a connu ces derniers temps. En particulier la technique du procès à distance, tous les pays ont convenu à l'unanimité de l'appliquer en raison de ses avantages pour faciliter les procédures contentieuses à distance, car le principal résultat de l'étude confirme que les effets de cette réforme ont été clairs et se sont traduits par l'amélioration qualitative des jugements rendus par la justice et l'efficacité du procès en préservant les droits et libertés des citoyens.
