Abstract

Abstract in English Investments are one of the fundamental pillars for achieving sustainable development, supporting the development of the national economy, and diversifying sources of income Based on this, the Algerian legislator adopted an incentive-based approach to support investors by issuing Law No 22/18, which introduced set of unprecedented guarantees .Among the most prominent of these is the protection of intellectual property-safeguard that was not included in previous legislations. The law also established a special High committee to examine appeals related to investment, in a move aimed at reinforcing principles of investors, herby contributing to an improved business climate and attracting freeing investments. ........................... ملخص بالغة العربية تُعد الاستثمارات من الركائز الأساسية لتحقيق التنمية المستدامة و المساهمة في تطوير الاقتصاد الوطني و تنويع مصادر الدخل و من هذا المنطلق،إعتمد المشرع الجزائري نهجًا تحفيزيا لدعم المستثمرين حيث قام بإصدار القانون رقم 22/18،الذي جاء بمجموعة من الضمانات غير مسبوقة،أبرزها حماية الملكية الفكرية،و هي ضمانة لم تكن حاضرة في التشريعات السابقة ،كما تضمن القانون إنشاء لجنة عليا خاصة للنظر في الطعون المتعلقة بالاستثمار،في خطوة تهدف إلى تعزيز مبادئ الشفافية و ضمان حقوق المستثمرين،بما يساهم في تحسين مناخ الأعمال و جذب الاستثمارات الأجنيبة. ........................... Résumé en français Les investissements constituent des piliers essentiels pour atteindre un durable, aider à développer l'économie nationale et diversifier les sources de revenus. Dans cette optique, le législateur algérien a adopté une approche incitative pour soutenir les investisseurs, en émettant la loi n°22/18, qui introduit un ensemble de garanties sans précédent, parmi lesquelles la protection de la propriété intellectuelle, une garantie absente dans les législations antérieures. La loi prévoit également la création d'une commission supérieure chargée d'examiner les recours liés aux investissements, dans le but de renforcer les principes de transparence et de garantir les droits des investisseurs, contribuant ainsi à améliorer le climat des affaires et à attirer les investissements étrangers.
