الاستجواب البرلماني كألية للرقابة على عمل الحكومة في التعديل الدستوري 2020

Abstract

Summary: Interrogation is one of the most sensitive control methods exercised by the legislative branch in terms of their impact on the executive branch. - Represented by the Government - to assumed its full ministerial political responsibility, on one of their constitutional powers excesses under the 2020 constitutional amendment of the People's Democratic Republic of Algeria; In its recent amendments, the Algerian legislator had tried to lift the effectiveness of the mechanism in order to achieve the principle of legality and the principle of separation of powers. By activating the impacts of parliamentary questioning by signing a motion of censure, which may result in the resignation of the entire Government. ................... ملخص: يعتبر الاستجواب من أخطر الوسائل الرقابية الحساسة التي تمارسها السلطة التشريعية من حيث الأثر في تحمل السلطة التنفيذية - متمثلة في الحكومة – مسؤوليتها الوزارية السياسية الكاملة، عن إحدى تجاوزاتها لصلاحياتها الدستورية في ظل التعديل الدستوري 2020 للجمهورية الجزائرية الديمقراطية الشعبية، حيث حاول المشرع الجزائري في تعديلاته الأخيرة الرفع من فعالية هذه الآلية لتحقيق مبدأ المشروعية ومبدأ الفصل بين السلطات عن طريق تفعيل الآثار المترتبة عن الاستجواب البرلماني من خلال توقيع لائحة ملتمس الرقابة، التي قد ينجم عنها استقالة الحكومة بأكملها.
