Abstract

Transparency is considered a fundamental principal in the fieled of public procurement under Algerian legislation, It requires the precise definition of procedures and objective standards governing procurement, and the stages of implementation. This is aimed at achieving legality, equality, and equal opportunities. The application of the principle of transparency is reflected in several legal aspects, notably the obligation to announce delegations of authority, the definition of their terms, and the guarantee of the right to access information. At the procedural level, the principle of transparency requires clear and specific procedures at all stages of preparation, commitment, and execution of delegated procurement. This includes publishing announcements, presenting negotiation documents in a clear and detailed manner, opening bids, and responding transparently to objecting parties to clarify their concerns, thereby reinforcing trust in the administration and ensuring equal opportunities. ............................ يعتبر مبدأ الشفافية قاعدة أساسية في مجال إبرام إتفاقيات تفويض المرفق العام لتشريع الجزائري، إذ يستوجب تحديدًا دقيقًا لإجراءات والمعايير المتعلقة باختيار المترشح، وشروط الاتفاقية، ومراحل تنفيذها، وذلك بهدف تحقيق العلانية والمساواة وتكافؤ الفرص بين المتنافسين. يتجلى تطبيق مبدأ الشفافية في عدة جوانب قانونية وإجرائية، المنظمة للإعلان عن التفويض وتحديد شروطه، وضمان حق الوصول إلى المعلومات. أمّا على المستوى الإجرائي، سيتطلب مبدأ الشفافية اتباع إجراءت واضحة ومحددة في مراحل الإعداد والإبرام وتنفذ لتفاقية التفويض، يشمل ذلك نشر الاعلانات، وتقديم وثائق المناقشة بشكل واضح ومفصل، وفتح الاظرفة وتقديم العروض بالشفافية، وإتاحة المجال للمتظلمين لتقديم طعونهم، بما يعزز الثقة في الإدارة وتكرّس المنافسة النزيهة. ......................... Le principe de transparence est une règle fondamentale dans le domaine de la conclusion des conventions de délégation de service public en Algérie. Il exige une définition précise des procédures et des critères liés au choix du candidat, des étapes de sa mise en œuvre, dans le but de garantir la légalité, l’égalité, la participation et l’égalité des chances entre les concurrents. L’application du principe de transparence se manifeste à travers plusieurs aspects juridiques et procéduraux organisant l’annonce de la délégation, la détermination de ses conditions et la garantie du droit d’accès à l’information. Au niveau procédural, le respect du principe de transparence nécessite le suivi de procédures claires et définies aux étapes de préparation et de conclusion de la convention de délégation. Cela inclut la publication des annonces, la présentation de documents de discussion de manière claire et détaillée, l’ouverture des plis et la soumission des àffres en toute transparence, ainsi que la possibilité pour les candidats de présenter leurs recours, ce qui renforce la confiance dans l’administration et consacre l’idée de concurrence loyale.
