The agreement to delegate a public utility has several forms, including four forms stipulated through Presidential Decree No. 15-247 related to organizing public deals and public utility authorizations, as well as Executive Decree No. 18-199 related to delegating the public utility, represented in the concession contract, lease and incentive agency contract And management, which is one of the delegation contracts approved for the proper functioning and utilization of the utility in accordance with the rules stipulated by law. ,,,,,,,,,,,,,,,,,,,,,,

الملخص : نظرا لتطور المرافق العامة وتعددها في مختلف المجالات الاقتصادية والاجتماعية والتي كانت الدولة المسير الأول لها ، فإن ذلك نتج عنه تطور وزيادة في حاجات ومتطلبات المواطنين من الخدمات العمومية، والتي جعلت الدولة عاجزة على مواجهة كافة هذه الأعباء مما جعلها تتبع أسلوب جديد لتلبية حاجات مواطنيها وتحقيق المردودية والنجاعة المطلوبتين ، حيث إعتمدت على مايعرف بتقنية تفويض المرفق العمومي، التي تعتبر أحد الأساليب المعتمدة في حسن تسيير وإستغلال المرافق العمومية سواءا المركزية منها أو المحلية التابعة للجماعات المحلية ، وذلك من خلال التنازل الجزئي للمرفق العمومي من قبل الدولة لأحد أشخاص القانون العام أو الخاص ، أي تفويض تسيير المرفق من السلطة المفوضة للموفض له مدة زمنية محددة، وتحت الرقابة الجزئية أو الكلية للسلطة المفوظة، كما يحصل صاحب التفويض على مقابل مالي يكون متعلق باستغلال المرفق وفق الشروط المحددة قانونا كما أن لإتفاقية تفويض المرفق العمومي عدة أشكال منها أربعة أشكال تم النص عليها من خلال المرسوم الرئاسي رقم 15-247 المتعلق بتنظيم الصفقات العمومية وتفويضات المرفق العام ، وكذلك المرسوم التنفيذي رقم 18-199 المتعلق بتوفيض المرفق العام، والمتمثلة في عقد الإمتياز والإيجار وعقد الوكالة المحفزة والتسيير، والتي تعتبر أحد عقود التفويض المعتمدة في حسن سير وإستغلال المرفق وفق القواعد المنصوص عليها قانونا , ,,,,,,,,,,,,,,,,,,,,,,,,,,, Résumé : En raison du développement des équipements publics et de leur multiplicité dans divers domaines économiques et sociaux, pour lesquels l'État était le principal guide, cela a entraîné un développement et une augmentation des besoins et des exigences des citoyens en matière de services publics, ce qui a rendu l'État incapable de faire face à toutes ces charges, ce qui l'a amenée à adopter une nouvelle méthode pour répondre aux besoins des citoyens et atteindre la rentabilité et l'efficacité requise, car elle s'est appuyée sur ce que l'on appelle la technique de délégation des services publics, considérée comme l'une des techniques approuvées. les modalités de bonne gestion et d'exploitation des équipements publics, centraux ou locaux, appartenant à des groupements locaux, par la cession partielle de l'équipement public par l'État à l'une des personnes de droit public ou privé, c'est-à-dire la délégation de la gestion de l'équipement du pouvoir délégué au bénéficiaire pour une durée déterminée, et sous le contrôle partiel ou total du pouvoir délégué. Le titulaire de l'autorisation reçoit également une compensation financière liée à l'exploitation de l'installation selon les conditions précisées par loi. La convention de délégation d'équipement public revêt également plusieurs formes, dont quatre formes qui ont été prévues par le décret présidentiel n° 15-247 relatif à l'organisation des transactions publiques et aux délégations d'équipement public, ainsi que le décret exécutif n° 18-199 relatif à la délégation. de l'installation publique, qui sont le contrat de concession et de location et le contrat d'agence d'incitation, et de gestion, qui est considéré comme l'un des contrats d'autorisation agréés pour le bon fonctionnement et l'exploitation de l'installation conformément aux règles prévues par la loi.
