Abstract

summary This study addressed the phenomenon of migrant smuggling across borders, as a form of organized crime that transcends national borders. This has prompted many countries to consider establishing a formula for international cooperation aimed at developing mechanisms and strategies to combat this phenomenon in order to achieve international security and stability. This is enshrined in both the United Nations Convention against Transnational Organized Crime and its Protocol against the Smuggling of Migrants by Land, Sea and Air. Algeria is among the countries affected by the negative repercussions of this phenomenon, and has therefore joined forces with the international community. It has sought to develop national strategies to implement its international obligations by adopting numerous preventive and deterrent mechanisms to address this dangerous phenomenon. ........................... ملخص تناولت هذه الدراسة ظاهرة تهريب المهاجرين عبر الحدود، باعتبارها شكل من أشكال الإجرام المنظم العابر للحدود الوطنية لكل دولة، هذا ما استدعى بالعديد من الدول ضرورة التفكير لإيجاد صيغة تعاون دولي يهدف لوضع آليات واستراتيجيات لمكافحة هذه الظاهرة من أجل تحقيق الأمن والاستقرار الدولي وهو ما كرسته كل من اتفاقية الأمم المتحدة لمكافحة الجريمة المنظمة عبر الوطنية وبروتوكول مكافحة تهريب المهاجرين عن طريق البر والبحر والجو الملحق لها. تعتبر الجزائر من بين الدول التي طالتها الانعكاسات السلبية لهذه الظاهرة، لذا ضمت جهودها إلى جهود المجتمع الدولي، حيث سعت لوضع استراتيجيات وطنية تنفيذا لالتزاماتها الدولية من خلال اتخاذها للعديد من الآليات الوقائية والردعية بغية التصدي لهذه الظاهرة الخطيرة. ...........................

Résumé Cette étude a examiné le phénomène du trafic illicite de migrants transfrontalier, une forme de criminalité organisée qui transcende les frontières nationales. Ce phénomène a incité de nombreux pays à envisager l'élaboration d'une formule de coopération internationale visant à élaborer des mécanismes et des stratégies de lutte contre ce phénomène afin de garantir la sécurité et la stabilité internationales. Ce principe est consacré par la convention des nations unies contre le trafic illicite de migrants par terre, air et mer et son protocole annexé L'Algérie fait partie des pays touchés par les répercussions négatives de ce phénomène et s'est donc associée à la communauté internationale. Elle a cherché à élaborer des stratégies nationales pour mettre en œuvre ses obligations internationales en adoptant de nombreux mécanismes de prévention et de dissuasion pour lutter contre ce phénomène dangereux.
