اﻟﻤﺰاﻳﺎ اﻻﺳﺘﺜﻨﺎﺋﻴﺔ ﻟﻼﺳﺘﺜﻤﺎر ﻓﻲ اﻟﺠﺰاﺋﺮ

Abstract

Summary: This study aimed to shed light on the most important advantages and guarantees granted to investment projects in order to send a real and effective investment that would enable the investor in Algeria to overcome the difficulties that he may face. On the one hand, as well as supporting the national economy on the other hand (tax incentives, legal guarantees). We relied on giving a somewhat detailed picture of investment and the evolution of its laws, as well as clarifying the exceptional advantages granted to investment projects in Algeria and their effectiveness. As Algeria sought to keep pace with the ranks of the developed countries by strengthening its laws with several versions and amendments to keep pace with the developments surrounding it with the conclusion of a set of agreements at all levels, but it was not actually able to make serious progress compared to other countries, especially in attracting foreign investments and the weak financing of internal investments. ....................... الملخص: هدفت هذه الدراسة إلى تسليط الضوء على أهم المزايا والضمانات الممنوحة للمشايع الاستثمارية لبعث استثمار حقيقي وفعال يمكّن المستثمر بالجزائر من التغلب على الصعوبات التي قد تواجهه، حيث تم التعرف من خلاله على أهم الأدوات الاستثمارية وكذا الضمانات والمزايا الاستثنائية التي من شأنها أن تشجع المستثمرين على الاستثمار من جهة، وكذا دعم الاقتصاد الوطني من جهة ثانية (الحوافز الجبائية، الضمانات القانونية). فاعتمدنا على إعطاء صورة مفصلة نوعا ما عن الاستثمار، وتطور قوانينه ، وكذا توضيح المزايا الاستثنائية الممنوحة للمشاريع الاستثمارية في الجزائر ومدى فعاليتها. حيث سعت الجزائر إلى مسايرة ركب الدول المتقدمة من خلال تعزيز قوانينها بعدة إصدارات وتعديلات لمجاراة التطورات المحيطة بها مع إبرام مجموعة اتفاقيات على جميع الأصعدة، إلا أنها لم تتمكن فعليا من التقدم الجاد مقارنة بدول أخرى خاصة في جذب الإستثمارات الأجنبية وضعف تمويل الإستثمارات الداخلية. ................. Résumé : L’objectif de cette étude est de mettre en évidence les avantages et les garanties les plus importants donnés aux projets d’investissement afin de créer un investissement réel et efficace qui permettra à l’investisseur en Algérie de surmonter les difficultés auxquelles il peut être confronté. Des instruments d’investissement, des garanties et des avantages exceptionnels qui encouragent les investisseurs à investir d’une part, et soutiennent l’économie nationale d’autre part (incitations fiscales, sauvegardes juridiques). Nous nous sommes appuyés sur une image assez détaillée de l’investissement et de l’évolution de ses lois, ainsi que sur la clarification des avantages exceptionnels et de l’efficacité des projets d’investissement en Algérie. L’Algérie a cherché à suivre le rythme des pays développés en renforçant ses lois par plusieurs questions et amendements pour suivre le rythme des développements qui les entourent et conclure une série d’accords à tous les niveaux. Cependant, il n’a pas été en mesure de faire des progrès sérieux par rapport à d’autres pays, en particulier pour attirer les investissements étrangers et le faible financement des investissements internes.
