Abstract

Abstract: Algeria aims to stimulate economic growth, expand incomes and optimize the available wealth to get out of dependence on the fuel market, which is no longer stable, which has greatly affected state revenues.This made the Algerian legislator move towards a market economy in order to attract capital by providing a suitable and fertile environment by attracting foreign investors by devoting the general principles of investment, namely freedom of investment, equality and transparency in investments, through amendments in the arsenal of its laws related to investment in application of what was stated in the recent constitutional amendment to the Investment Law 22-18 and granting it new incentives and benefits in line with international conventions and treaties and ensuring The stability of the provisions of this law and the right to resort to private arbitration to resolve disputes that may arise as well as granting the investor the freedom to transfer capital and its returns, all these guarantees are a factor in the success of any development policy and cover a strong push to attract foreign investors to invest in Algeria. .............................. ملخص: تهدف الجزائر إلى تحريك عجلة النمو الاقتصادي وتوسيع المداخيل والاستغلال الأمثل للثروات المتاحة للخروج من التبعية لسوق المحروقات التي لم تعد مستقرة فهذا ما أثر بشكل كبير على إيرادات الدولة.الشيء الذي جعل من المشرع الجزائري يتجه نحو اقتصاد السوق من أجل جلب رؤوس الأموال عند طريق توفير مناخ ملائم وخصب بجذب المستثمر الأجنبي وذلك عن طريق تكريس المبادئ العامة للاستثمار ألا وهي حرية الاستثمار المساواة و الشفافية في الاستثمارات و ذلك من خلال التعديلات في ترسانة قوانينه المتعلقة بالاستثمار تطبيقا لما جاء في التعديل الدستوري الأخير لقانون الاستثمار 22-18 ومنحه حوافز ومزايا جديدة مع ما يتماشى مع الاتفاقيات و المعاهدات الدولية وضمان استقرار أحكام هذا القانون وضمن حق اللجوء إلى التحكيم الخاص لحل المنازعات التي قد تنشأ كما منح المستثمر حرية تحويل رؤوس الأموال و عائداتها، وكل هذه الضمانات تعبر عاملا من عوامل نجاح أي سياسة تنموية و تغطي دفعا قويا لجذب المستثمر الأجنبي للاستثمار في الجزائر. ............................... Résumé L'Algérie vise à stimuler la croissance économique , à augmenter les revenus et à optimiser l'utilisation des richesses disponibles pour sortir de la dépendance au marché des carburants, qui n'est plus stable, ce qui a fortement affecté les recettes de l'État.Cela a poussé le législateur algérien à s'orienter vers une économie de marché afin d'attirer les capitaux en fournissant un environnement propice et fertile en attirant les investisseurs étrangers en consacrant les principes généraux de l'investissement, à savoir la liberté d'investissement, l'égalité et la transparence des investissements, à travers des amendements à l'arsenal de ses lois relatives à l'investissement en application de ce qui a été énoncé dans le récent amendement constitutionnel à la loi sur l'investissement 22-18 et en lui accordant de nouvelles incitations et avantages conformément aux accords. Les traités internationaux et la garantie de la stabilité des dispositions de cette loi et le droit de recourir à l'arbitrage privé pour résoudre les litiges qui peuvent survenir ainsi que l'octroi à l'investisseur de la liberté de transférer le capital et ses rendements, toutes ces garanties sont un facteur de réussite de toute politique de développement et recouvrent une forte volonté d'attirer les investisseurs étrangers à investir en Algérie.
