الضمانات القانونية لحق الترشح للإنتخابات في التشريع الجزائري

Abstract

Summary : The Algerian legislature has endeavoured to guarantee the right to run. through the principles and conditions enshrined in both the Constitution and the 21_01 ordinance on the Organic Law of the Electoral System, demonstrated in all stages of the electoral process, particularlythose disputes relating to the process of candidacy, whetherwereformalprocedures or practicalresults, in order to protect the right to stand or to protect the electoral process as a whole, and to achievefair and justelections. ....................................... الملخص : لقد سعى المشرع الجزائري جاهدا إلى ضمان وكفالة حق الترشح، من خلال المبادئ والشروط التي نص عليها كل من الدستور والأمر 21/01 المتعلق بالقانون العضوي لنظاما الإنتخابات الذي وضح وبين جميع مراحل العملية الإنتخابية، لا سيما تلك المنازعات المتعلقة بعملية الترشح سواء كانت إجرائية أو شكلية أو نتائج عملية، وذلك من أجل حماية حق المترشح أو من أجل حماية العملية الإنتخابية ككل ، وتحقيق انتخابات نزيهة وعادلة.
