Abstract

Summary The terms book in public transactions is one of the most important administrative documents on which public transactions are based as it plays a role in the transparency of the conclusion and implementation of public transactions, This is all the more important given that the terms book is linked to the disbursement of public money. In order to rationalize public expenditures, the legislator endeavoured to give the Clause Book numerous legal safeguards of all degrees at all stages of its preparation. On this basis, our study focused on the terms book in public transactions by demonstrating its role in establishing the principle of transparency. .......................... الملخص: يعتبر دفتر الشروط في الصفقات العمومية من أهم الوثائق الإدارية التي تبنى عليها الصفقات العمومية، لما لها من دور في تكريس شفافية إبرام الصفقات العمومية وتنفيذها، وتزداد هذه الأهمية بالنظر لارتباط دفتر الشروط بصرف المال العام، ومن أجل ترشيد النفقات العمومية عمل المشرع على إيلاء دفتر الشروط بعديد الضمانات القانونية على اختلاف درجاتها في جميع المراحل التي يمر بها إعداده. وعلى هذا الأساس انصبت دراستنا على دفتر الشروط في الصفقات العمومية من خلال تبيان دوره في تكريس مبدأ الشفافية. ........................ Résumé Le cahier des charges des marchés publics est considéré comme l'un des documents administratifs les plus importants sur lesquels sont construits les marchés publics, en raison de son rôle dans l'établissement de la transparence de la conclusion et de la mise en œuvre des marchés public; et afin de rationaliser les dépenses publiques, le législateur s'est efforcé de doter le cahier des charges de nombreuses garanties légales de degrés divers à toutes les étapes de son élaboration. Sur cette base, notre étude s'est concentrée sur le cahier des charges dans les marchés publics en montrant son rôle dans l'établissement du principe de transparence.
