Summary : The factoring contract creates a common bond on the part of the mediator. This contract grants its parties rights, such as economic services represented in collecting commercial debts and financing investments, which contributes to the development of institutions and their activities and thus achieves economic development. In the event that both parties to the contract, i.e. the mediator and the party, breach the contract, they will bear civil and criminal liability. ............................... الملخص: إن عقد الفاكتورينغ ينهج رابطة مشتركة من جهة الوسيط فكلما زاد عدد الزبائن قابله زيادة في عدد الفواتير المقدمة إليه من قبل المنتمي، فتحقيق الأهداف ينجح المشروع الذي يملكه وهذا يعني تحقيق الربح.حيث أن هذا العقد يمنح أطرافه حقوق، كالخدمات الإقتصادية والمتمثلة في تحصيل الديون التجارية،وتمويل الإستثمارات مما يساهم في تطوير المؤسسات وأنشطتها وبالتالي يحقق التنمية الإقتصادية.وفي حالة إخلال طرفي العقد أي الوسيط والمنتمي تقع على عاتقهم المسؤولية المدنية والجزائية. ............................ Résume : Le contrat d'affacturage crée un lien commun de la part du médiateur. À mesure que le nombre de clients augmente, il rencontre une augmentation du nombre de factures qui lui sont soumises par l'affilié. En atteignant les objectifs, le projet qu'il possède réussit, et cela signifie réaliser du profit. Ce contrat accorde à ses parties des droits, tels que les services économiques représentés dans le recouvrement des dettes commerciales et le financement des investissements, ce qui contribue au développement des institutions et de leurs activités et réalise ainsi le développement économique. En cas de rupture du contrat par les deux parties au contrat, c'est-à-dire le médiateur et la partie, elles engageront leur responsabilité civile et pénale.
