Abstract : In the framework of transparency in the conduct of public affairs and the fight against corruption, under the constitutional amendment of 2020, a watchdog institution called " "The Supreme Authority for Transparency and the Prevention and Combating of Corruption", granted by both the constitutional founder and the Algerian legislature broad powers in the field of preventing and combating corruption National Authority for the Prevention and Combating of Corruption ", which has previously failed to achieve the desired effectiveness in the fight against corruption, The Supreme Authority has also been assigned a legal system that allows it to tackle the phenomenon of corruption. by granting it the power to develop a national strategy with comprehensive preventive measures, The Supreme Authority also monitors all institutions and notifies the judiciary whenever criminal facts are discovered. ............................... الملخص: في إطار تكريس الشفافية في تسيير الشؤون العامة ومكافحة الفساد تم بموجب التعديل الدستوري لسنة 2020 إنشاء مؤسسة رقابية تدعى في صلب النص "السلطة العليا للشفافية والوقاية من الفساد ومكافحته" منحها كل من المؤسس الدستوري والمشرع الجزائري صلاحيات واسعة في مجال الوقاية من الفساد ومكافحته، وهذا بعد عجز الهيئة الوطنية للوقاية من الفساد ومكافحته في السابق عن تحقيق الفعالية المرجوة في مكافحة الفساد،كما تم إفراد السلطة العليا بنظام قانوني يسمح لها بالتصدي لظاهرة الفساد، وذلك من خلال منحها صلاحية وضع إستراتجية وطنية تتضمن تدابير وقائية شاملة، كما تقوم السلطة العليا بمراقبة جميع المؤسسات وكذا إخطار السلطة القضائية كلما إكتشفت وقائع ذات صبغة جزائية. ......................... Résumé : Dans le cadre de la transparence dans la conduite des affaires publiques et de la lutte contre la corruption, dans le cadre de l’amendement constitutionnel de 2020, une institution de surveillance appelée "Autorité suprême pour la transparence et la prévention et la lutte contre la corruption"", accordé par le fondateur constitutionnel et le législateur algérien de larges pouvoirs dans le domaine de la prévention et de la lutte contre la corruption Autorité nationale pour la prévention et la lutte contre la corruption"L’Autorité suprême a également été dotée d’un système juridique qui lui permet de lutter contre le phénomène de la corruption. En lui accordant le pouvoir d’élaborer une stratégie nationale comportant des mesures préventives complètes, l’Autorité suprême surveille également toutes les institutions et informe le pouvoir judiciaire chaque fois que des faits criminels sont découverts.
