Abstract

Summury Historical experiments have proven that the application of a declaration of rights depends on the will and determination of the people to achieve their freedom. However, this does not diminish their theoretical value, as these texts are considered a guiding factor, enlightening minds, and guiding nations. Rights declarations are no longer confined to old human rights conventions. Efforts have gone beyond this scope, extending legal protection for human rights regarding prisoners' freedom not only to national legislation but also as a subject matter covered by international agreements with the aim of enriching domestic legal regulations governing human rights. ..................... ملخص: أظهرت التجارب التاريخية أن تنفيذ إعلان حقوق يتوقف على إرادة الشعوب وعزمها على تحقيق حريتها. ومع ذلك، لا ينقص ذلك من القيمة النظرية لهذه الإعلانات، إذ تعتبر هذه الوثائق عاملًا هامًا من أعوامل التوجيه والتنوير الذهني والتوجيه للشعوب. ومن المهم أن نلاحظ أن إعلانات حقوق لم تعد مقتصرة على المواثيق الحقوقية القديمة. إذ تجاوزت الجهود هذا النطاق لتمتد الحماية القانونية لحقوق الإنسان بخصوص السجناء حراً إلى التشريعات الوطنية وأصبحت أيضًا موضوعًا يتعامل معه الاتفاقيات الدولية بهدف إثراء التشريعات الوطنية المتعلقة بحقوق الإنسان. ..................... Résumé L’expérience historique a montré que la mise en œuvre d’une Déclaration des droits dépend de la volonté et de la détermination des peuples à réaliser leur liberté. Cependant, cela ne diminue pas la valeur théorique de ces déclarations, car ces documents sont un facteur important d’orientation, d’illumination mentale et d’orientation pour les peuples. Il est important de noter que les déclarations de droits ne se limitent plus aux anciennes chartes des droits de l’homme. Les efforts ont dépassé le cadre de la libre protection juridique des droits de l’homme pour les prisonniers à la législation nationale et sont également devenus un sujet de conventions internationales en vue d’enrichir la législation nationale des droits de l’homme.
