Abstract

Memory Summary: The development of the protection of rights and freedoms in Algerian constitutions, is one of the important subjects that has received great attention from jurists and jurisprudents in the definition of the most important concepts and characteristics related to rights and freedoms. Or the subject of our research revolves around a fundamental idea that is represented in the evolution of rights and freedoms through the successive constitutions since the independence of Algeria until the developments of the last amendment 2020 which is the result of a peaceful movement that called for more reforms related to rights and freedoms, and to identify the most important safeguards and mechanisms protecting these rights and the changes that have occurred. This subject ended with the achievement of the most important results and suggestions which are to ensure the realization of this set of rights and freedoms in legislative texts compatible with the constitutional amendment. ............................... ملخص المذكرة: تطور حماية الحقوق والحريات في الدساتير الجزائرية من المواضيع الهامة التي نالت اهتمام كبير من قبل رجال القانون والفقه، وذلك في تحديد المفاهيم وأهم الخصائص التي تتعلق بالحقوق والحريات. حيث يدور موضوع بحثنا حول فكرة جوهرية التي تتمثل في تطور الحقوق والحريات غير الدساتير المتعاقبة منذ استقلال الجزائر إلى مستجدات آخر تعديل 2020 الذي جاء جراء حراك سلمي مطالب بمزيد من الاصلاحات المتعلقة بالحقوق والحريات والتعرف على أهم الضمانات والآليات الحامية لهذه الحقوق والتغيرات التي طرأت عليها. وانتهت دراسة هذا الموضوع بالوصول إلى أهم النتائج، والاقتراحات التي تتمثل في السهر على تجسيد هذا الكم من الحقوق والحريات في النصوص التشريعية التي تتوافق مع التعديل الدستوري. ................................. Résumé de mémoire : Le développement de la protection des droits et libertés dans les constitutions algériennes, est l'un des sujets importants qui a reçu une grande attention de la part des juristes et des jurisprudents dans la définition des concepts et des caractéristiques les plus importantes liées aux droits et libertés. Ou le sujet de notre recherche s'articule autour d'une idée fondamentale qui est représentés dans l'évolution des droits et libertés a travers les constitutions successives depuis l'indépendance de l'Algérie jusqu'aux développements du dernier amendement 2020 qui est le résultat d'un mouvement pacifique qui a appelé a davantage de réformes liées aux droits et libertés, et a identifier les garanties et mécanismes les plus importants protégeant ces droits et les changements qui s'q sont produits L'étude. De ce sujet s'est terminée par l'atteinte des résultats et des suggestions les plus importants qui sont d'assurer la concrétisation des cet ensemble de droits et libertés dans des textes législatifs compatibles avec l'amendement constitutionnel.
