خصوصية متابعة الأحداث الجانحين في التشريع الجزائري

Abstract

Summary. The Algerian legislator has paid attention to the category of juvenile delinquents by establishing a set of special procedural rules during their follow-up, starting with the stage of investigation and inquiry, then the investigation and trial. On the one hand, it has allocated judges who are competent in juvenile affairs to adjudicate their cases. On the other hand, it has established guarantees for them throughout these various stages, with the aim of reforming them, refining their behavior and correcting them, to prevent their punishment and deter them. It has also given great attention to the stage of implementing the criminal judgment against them, as it has allocated a group of bodies and centers for them specialized in protecting children at risk. ....................... ملخص. لقد إهتم المشرع الجزائري بفئة الأحداث الجانحين من خلال وضع جملة من القواعد الإجرائية الخاصة، وذلك أثناء متابعتهم، بدءا بمرحلة البحث والتحري، ثم التحقيق والمحاكمة، وخصص لهم قضاة متمكنين في شؤون الأحداث للفصل في قضاياهم هذا من جهة، ومن جهة أخرى أقر لهم ضمانات على طول مختلف هذه المراحل، بهدف إصلاحهم وتهذيب سلوكهم وتقويمهم، للحيلولة دون عقابهم وردعهم ، كما أعطى لمرحلة تنفيذ الحكم الجزائي ضدهم إهتماما كبيرا ، حيث خصهم بمجموعة من الهيئات والمراكز متخصصة في حماية الطفولة المعرضة للخطر . ..................... résumé. Le législateur algérien a accordé une attention particulière à la catégorie des mineurs délinquants en établissant un ensemble de règles procédurales particulières lors de leur suivi, en commençant par l'étape de l'enquête et de l'instruction, puis de l'instruction et du procès. D’une part, elle a désigné des juges compétents en matière de mineurs pour juger leurs affaires. D'autre part, elle a établi des garanties pour eux tout au long de ces différentes étapes, dans le but de les réformer, d'affiner leur comportement et de les corriger, pour prévenir leur punition et les dissuader. Elle a également accordé une grande attention à l'étape de mise en œuvre du jugement pénal à leur encontre, en leur affectant un groupe d'organismes et de centres spécialisés dans la protection des enfants en danger.
