Abstract

Abstract : This study aimed to clarify the judicial oversight on the defect of reason between legality and appropriateness in administrative decisions Where the control focused on material facts and legal adaptation, as well as the exceptional circumstances that impose judicial control, and by this the judge exercise control over legality and appropriateness. ملخص : هدفت هذه الدراسة الى بيان الرقابة القضائية على عيب السبب بين المشروعية والملاءمة في القرارات الادارية، حيث اتعبت الرقابة على الوقائع المادية و التكييف القانوني وكذلك الظروف الاستثنائية التي تستوجب الرقابة القضائية، وبذلك يمارس القاضي رقابة المشروعية والملاءمة.
