The establishment of the sharia prosecution system for the management and sale of a minor's property is to protect him from various exploitation. ..................... ملخص: تحتاج أعمال الإدارة والبيع إلى شخص يقوم بها، يكون هذا الشخص واعي، وبكامل أهليته، وبما أن القاصر يعتبر ناقص الأهلية غير قادر على القيام بهذه التصرفات بنفسه، فقد وضع له المشرع نظاما لحمايته وهي النيابة الشرعية والتي تتمثل في (الأب أو الأم أو الوصي) التي تقوم بجميع هذه الأعمال نيابة عن القاصر، ولحمايته من إستغلال أمواله جعل التصرفات التي يقوم بها النائب الشرعي تخضع لرقابة القاضي، وقد جعل بيع أموال القاصر بالمزاد العلني حماية لأمواله، إضافة إلى ذلك فقد أعطى القاضي للقاصر المميز الحق في الحصول على الإذن للتصرف في أمواله، ووضع نظام النيابة الشرعية لإدارة وبيع أموال القاصر هو لحمايته من شتى الإستغلال. .......................... Résumé : Les actions de l’administration et de la vente doivent être exécutées par une personne consciente et pleinement compétente. Étant donné qu’un mineur est considéré incapable de réaliser de tels actes lui-même, le législateur a mis en place un système pour sa protection, à savoir le Shari 'un service de poursuite, qui est (père, mère ou tuteur) qui accomplit tous ces actes pour le compte du mineur afin de le protéger de l’exploitation de ses biens, les actions du législateur sont soumises à la surveillance du juge; La vente aux enchères des biens d’un mineur a protégé ses biens.
