الرقابة على العقار الفلاحي في التشريع الجزائري

Abstract

Summary: The agricultural estate is one of the most sensitive sectors, as it is a real wealth of the state, generating substantial funds on the public treasury in the framework of sustainable economic development. It also leads to self-sufficiency, food security and the elimination of external dependence diversification of the source of wealth and upgrading of the State to the ranks of developed countries, in addition to contributing to the creation of environmental balance. The Jazarri legislature has attached great importance to the agricultural drug in regulatory terms, and this interest has emerged from the occupation period until after independence, in order to ensure optimal control of the drug, which leads to its good exploitation and protection. ..................... ملخص : يعتبر العقار الفلاحي من أهم القطاعات الحساسة جدا، باعتبارها ثروة حقيقية للدولة حيث تدر بأموال طائلة على الخزينة العمومية في إطار التنمية الاقتصادية المستدامة، كما تؤدي إلى الاكتفاء الذاتي وتحقيق الأمن الغذائي و إنهاء التبعية الخارجية، وبالتالي التقليل من الاستيارد يقابله الزيادة في قيمة الصادارت خارج مجال المحروقات وتنويع مصدر الثروة والرقي بالدولة إلى مصاف الدول المتقدمة، بالإضافة إلى المساهمة في خلق التوازن البيئي. وقد أولى المشرع الجازئري أهمية بالغة للعقار الفلاحي من الناحية التنظيمية، و برز هذا الاهتمام منذ فترة الاحتلال إلى ما بعد الاستقلال، بغية الوصول إلى ضمان رقابة أمثل لهذا العقار و التي تؤدي إلى حسن استغلاله و حمايته. ......................... Résumé : Le domaine agricole est l’un des secteurs les plus sensibles, car c’est une véritable richesse de l’État, générant des fonds substantiels sur le trésor public dans le cadre du développement économique durable. Elle conduit également à l’autosuffisance, à la sécurité alimentaire et à l’élimination de la dépendance extérieure, à la diversification de la source de richesse et à la revalorisation de l’État au rang des pays développés, en plus de contribuer à la création d’un équilibre environnemental. Le législateur Jazarri a accordé une grande importance à la drogue agricole en termes réglementaires, et cet intérêt est apparu de la période d’occupation jusqu’après l’indépendance, afin d’assurer un contrôle optimal de la drogue, ce qui conduit à sa bonne exploitation et protection.
