ضمانات الإسثمارات الأجنبية في التشريع الجزائري

Abstract

Summary The foreign investment is a fundamental support for any developed economic renaissance and one of the development tributaries, given the transfer of technology and the technical and managerial expertise of the host country. The Algerian state has therefore made considerable efforts to establish an effective legal system that would provide adequate protection to ensure capital flows through the development of legal, financial and judicial privileges and guarantees that encourage the attraction of foreign investment, as well as the development of mechanisms to frame the investment process and facilitate administrative procedures. However, the legislator retreated from its incentive policy by legislating several restrictive measures that affect all stages of the investment process, starting from the creation stage to filter liquidation. This has negatively affected the volume of investment that have been inbound in Algeria, which witnessed a weak interest limited to certain sectors, which led to its classification among the last ranks of the polarized countries for investment. ................... ملخص : يعتبر الاستثمار الأجنبي داعما أساسيا لأي نهضة إقتصادية متطورة وأحد روافد التنمية ، نظرا لما يحمله من نقل للتكنولوجيا والخبرات الفنية والغدارية للبلد المضيف ، لذا قامت الدولة الجزائرية ببذل جهود معتبرة لإقامة نظام قانوني فعال من شانه توفير القدر الكافي من الحماية لضمان تدفق رؤوس الاموال إليها ، وذلك بوضع عدة إمتيازات وضمانات تشريعية ومالية ، وأخرى قضائية تشجع على إستقطاب الإستثمار الأجنبي، إلى جانب إستحداث أجهزة لتأطير العملية الإستثمارية وتسهيل الإجراءات الإدارية، لكن ما لبث المشرع أن تراجع عن سياسته التحفيزية وذلك بتشريعه لعدة إجراءات مقيدة تمس جميع مراحل العملية الإستثمارية بدءا من مرحلة الإنشاء إلى غاية التصفية، وهو ما إنعكس سلبا على حجم الإستثمارات الوافدة من الجزائر والتي شهدت إقبالا ضعيفا ومحتشما مقتصرا على قطاعات معينة فقط، وقد أدى ذلك إلى تصنيفها ضمن المراتب الأخيرة للدول المستقطبة للإستثمار . .....................

Résumé : L’investissement étranger est un soutien essentiel à toute renaissance économique sophistiquée et contribue au développement. Compte tenu du transfert de technologies et de compétences techniques et surrénales vers le pays d’accueil, l’État algérien a donc déployé des efforts considérables pour mettre en place un système juridique efficace qui assurerait une protection adéquate pour assurer la circulation des capitaux. en établissant plusieurs privilèges et garanties législatives, financières et judiciaires qui encouragent l’investissement étranger En plus de développer des instruments pour encadrer le processus d’investissement et faciliter les procédures administratives, Cependant, en légiférant plusieurs mesures restrictives touchant toutes les étapes du processus d’investissement, de l’établissement à la liquidation, le législateur n’a pas pu inverser sa politique de relance. ", ce qui a eu un impact négatif sur le volume des investissements en provenance d’Algérie, qui a vu une participation faible et décisive limitée à certains secteurs seulement, ce qui a conduit à les classer parmi les derniers rangs d’investissement des pays polarisants.
