Abstract

Abstract: The world is witnessing an unprecedented rise in the frequency and severity of environmental disasters and climate change impacts, leading to the emergence of a vulnerable category of individuals known as environmental displaced persons. This research explores the extent to which international environmental law can ensure effective legal protection for this group, especially in the absence of explicit recognition within binding international legal frameworks. The first chapter examines the conceptual framework of environmental displacement, reviewing definitions, legal interpretations, and distinctions from related terms such as refugee and migrant. It also assesses the applicability of international human rights law and refugee law to this emerging phenomenon. The second chapter analyzes the available protection tools within international environmental law, focusing on major environmental conventions and key precautionary principles such as prevention, precaution, and transboundary impact. The study concludes that although international environmental law offers indirect protection through its principles and mechanisms, the absence of binding obligations renders it insufficient. The research recommends adopting a unified legal definition of environmental displacement and establishing new legal and institutional frameworks that guarantee meaningful protection for affected populations. ........................... ملخص البحث يشهد العالم تزايدًا غير مسبوق في حدة الكوارث البيئية والتغيرات المناخية، مما أدى إلى بروز فئة من المتضررين تُعرف بالنازحين البيئيين. وتطرح الإشكالية في مدى قدرة القانون الدولي للبيئة على توفير حماية قانونية فعالة لهذه الفئة، في ظل غياب اعتراف صريح ضمن الصكوك القانونية الدولية الملزمة. يتناول الفصل الأول الإطار المفاهيمي للنزوح البيئي، من خلال تعريف الظاهرة، وتفسيرها القانوني، والتمييز بينها وبين مصطلحات أخرى كالمهاجر واللاجئ. كما يسلط الضوء على مدى انطباق قواعد القانون الدولي لحقوق الإنسان والقانون الدولي للاجئين على هذه الظاهرة المتنامية. أما الفصل الثاني، فقد خصص لتحليل أدوات الحماية في القانون الدولي للبيئة، من خلال عرض الاتفاقيات البيئية والمبادئ الوقائية ذات الصلة كالحيطة، والوقاية، والتأثير العابر للحدود. وقد خلص البحث إلى أن القانون الدولي للبيئة يوفر حماية غير مباشرة للنازحين البيئيين من خلال مبادئه، ولكن تبقى الآليات القائمة غير كافية، وهو ما يستدعي وضع تعريف قانوني موحد للنزوح البيئي، وإنشاء آليات مؤسسية جديدة تكون ضامنة لهذه الفئة المتضررة. ............................. Le monde connaît une augmentation sans précédent de la fréquence et de la gravité des catastrophes environnementales et des effets du changement climatique, ce qui a conduit à l’émergence d’une catégorie vulnérable de personnes appelées « déplacés environnementaux ». Cette recherche examine dans quelle mesure le droit international de l’environnement peut offrir une protection juridique efficace à cette catégorie, en particulier en l’absence de reconnaissance explicite dans les instruments juridiques internationaux contraignants. Le premier chapitre examine le cadre conceptuel du déplacement environnemental, à travers la définition du phénomène, son interprétation juridique, et la distinction avec d’autres termes tels que « réfugié » et « migrant ». Il met également en lumière l’applicabilité des règles du droit international des droits de l’homme et du droit international des réfugiés à ce phénomène croissant. Le second chapitre est consacré à l’analyse des mécanismes de protection dans le droit international de l’environnement, en présentant les principales conventions environnementales et les principes de précaution pertinents tels que la prudence, la prévention et l’impact transfrontière. L’étude conclut que le droit international de l’environnement offre une protection indirecte aux déplacés environnementaux à travers ses principes, mais que les mécanismes existants restent insuffisants. Elle recommande donc l’adoption d’une définition juridique unifiée du déplacement environnemental ainsi que la mise en place de nouveaux mécanismes institutionnels garantissant une protection adéquate à cette
