المسؤولية الدولية لفرنسا عن تجاربها النووية في الجزائر

Abstract

Summary: In order to achieve its goal of acquiring nuclear weapons, France was motivated by its creation, indifferent to its repercussions and damage, because its objective was to strengthen its international standing and to acquire new military deterrence capabilities to counter armed resistance movements that activated their weapons and conducted their nuclear tests on colonial territory, first in the Sahara of Algeria and then in Polynesia. In this regard, we have dealt with the beginning of the topic of international responsibility in accordance with the developments of the International Law Commission, which has stated in its reports that international responsibility rests with the wrongdoing States. Accordingly, we have tried to highlight the crimes committed by France in Algeria during the colonial period in which it began to carry out its criminal schemes using the prisoners of the mujahideen and the inhabitants of the Saharan region as as as as rats. In addition, highlight the legal foundations that can be relied upon to establish France's responsibility for its nuclear tests in Algeria and to obtain legal results that demonstrate this, while highlighting the reaction of civil society to defend the rights of victims of such tests and their relatives demanding their retrieval ............................ ملخص : على سبيل تحقيق فرنسا لهدفها في اكتساب السلاح النووي اندفعت في إنشائه غير مبالية بانعكاساته ولا الأضرار الناتجة عنه لان هدفها هو تدعيم مكانتها دوليا و الحصول على قدرات ردع عسكرية جديدة لمواجهة حركات المقاومة المسلحة قامت بتفعيل سلاحها و إجراء تجاربها النووية على الأراضي المستعمرة بداية بصحراء الجزائر ثم بولينيزيا و في هذا الصدد تناولنا بداية موضوع المسؤولية الدولية حسب المستجدات التي جاءت بها لجنة القانون الدولي و التي نصت من خلال تقاريرها إلى إن المسؤولية الدولية تقع على عاتق الدول المرتكبة للفعل غير المشروع وبناءا على هذا حاولنا إبراز الجرائم التي ارتكبتها فرنسا في الجزائر ابان الاستعمار الذي باشرت فيه بتنفيذ مخططاتها الإجرامية مستعملة أسرى المجاهدين و سكان منطقة الصحراء كفئران تجارب لتجاربها النووية و إلحاق الضرر عليهم و بيئة المنطقة. إضافة إلى ذلك إبراز الأسس القانونية التي يمكن الاعتماد عليها لتأسيس مسؤولية فرنسا عن تجاربها النووية في الجزائر و الوصول إلى النتائج القانونية التي تثبت ذلك مع إبراز رد فعل المجتمع المدني للدفاع عن حقوق ضحايا هذه التجارب و ذويهم المطالبة باسترجاعها ............................. Pour atteindre l'objectif de la France d'acquérir des armes nucléaires, il s'est empressé de la rendre indifférente à ses répercussions et aux dommages qui en résultent, car son objectif est de renforcer son statut international et de se doter de nouvelles capacités militaires de dissuasion pour faire face aux mouvements de résistance armés et procéder à des essais nucléaires sur des terres coloniales à partir du Sahara d'Algérie. Polynésie À cet égard, nous avons abordé le sujet de la responsabilité internationale en fonction de l'évolution de la Commission du droit international, qui a déclaré dans ses rapports que la responsabilité internationale incombait aux pays qui se seraient engagés à commettre l'acte illicite. Dans la mise en œuvre de ses stratagèmes criminels, les prisonniers des Moudjahidines et les habitants de la région du Sahara sont utilisés comme souris d’essai pour leurs essais nucléaires et pour nuire à eux-mêmes et à l’environnement de la région En plus de mettre en évidence les bases juridiques sur lesquelles on peut compter pour établir la responsabilité de la France pour ses expériences nucléaires en Algérie et pour atteindre les résultats juridiques qui le prouvent, tout en soulignant la réaction de la société civile à défendre les droits des victimes de ces expériences et de leurs proches qui exigent leur restauration
