جريمة تلقي الأموال والهبات في ظل القانون الجزائري

Abstract

Summary: The offence of receiving funds and donations under Algerian law is an offence of corruption. This research has sought to identify this offence by addressing its concepts, elements and some crimes that are somewhat similar to this offence. This study also clarified the preventive framework for this crime in both the Corruption Prevention and Control Act and the Code of Criminal Procedure. This research also sought to detect the procedures in place to counter the crime, the penalties for corruption offences, the fact that the offence of receiving funds and donations is an integral part and the offences of corruption. .................... ملخص : تدخل جريمة تلقي الأموال و الهبات في ظل القانون الجزائري ضمن جرائم الفساد ، إذ نجد أن هذا البحث قد سعى الى الإهتمام بالتعرف على هذه الجريمة من خلال التطرق إلى مفهومها و أركانها و بعض الجرائم المشابهة نوعا ما لهذه الجريمة . كما وضحت هذه الدراسة الإطار الوقائي لهذه الجريمة في كل من قانون الوقاية من الفساد ومكافحته وقانون الإجراءات الجزائية . كذلك سعى هذا البحث في الكشف عن الإجراءات المطبقة لمواجهة الجريمة ، و العقوبات المقررة لجرائم الفساد كون جريمة تلقي الأموال و الهبات جزء لا يتجزأ وجرائم الفساد . ..................... Résumé : Le délit de réception d’argent et de cadeaux selon la loi algérienne est inclus dans les délait de corruption car nous constation que cette recherche a cherché a l’identification de ce délit en abordant son concepte et ses éléments et certains délits quelque peu similaires a cette interdiction . Cette letter a egalement clarifié le cadre de prévention de ce crime tant danse la loi sur la prévention et la lutte contre la corruption que dans le code de procédure pénale algériene . Cette recherche a également cherché a révélerles procédures appliquées pour faire face au délit et les peines prévues pour les délit de réception dargent et de cadeaux fait partie intégrante des délits de corruption .
