Abstract

Abstract: This study deals with the topic of the role of administrative control bodies in maintaining public order in various areas of life in Algeria, where the research aims to determine the extent to which the control bodies at the central and decentralized levels contribute to maintaining security and public order with all its resistances, including the restrictions it contains. rights and freedoms and to highlight the role played by the President of the Republic in the field of administrative control according to the constitutional powers conferred upon him, in addition to the role of central and decentralized control bodies. Administrative control procedures in normal situations are subject to restrictions or controls that focus on administrative control procedures and measures in general, and some may also occur Exceptional cases that justify expanding the powers of the administrative control authority in accordance with these circumstances, provided that these bodies are committed to observing the principle of legality. ............... الملخص : تتناول هذه الدراسة موضوع دور هيئات الضبط الإداري في المحافظة على النظام العام في مختلف مجالات الحياة في الجزائر، حيث يهدف البحث إلى الوقوف على مدى مساهمة الهيئات الضبطية على المستويين المركزي واللامركزي في الحفاظ على الامن و النظام العام بجميع مقاوماته المتخذة ّ مع ما تضمنته من تقييد للحقوق والحريات و ابراز الدور الذي مارسه رئيس الجمهورية في مجال الضبط الاداري بموجب الصلاحيات الدستورية المخولة له، إلى جانب دور هيئات الضبط المركزية واللامركزية ، تخضع إجراءات الضبط الإداري في الأوضاع العادية لقيود أو ضوابط تنصب على إجراءات وتدابير الضبط الإداري بصفة عامة . كما يمكن أن تحدث بعض الحالات الاستثنائية التي تبرر توسيع الاختصاصات المخولة لسلطة الضبط الإداري وفقا لهذه الظروف شريطة أن تلتزم هذه الهيئات بمراعاة مبدأ المشروعية. ..................... Résumé : Cette étude traite du rôle des organes de contrôle administratif dans le maintien de l’ordre public dans divers domaines de la vie en Algérie. Le but de la recherche est de déterminer dans quelle mesure les instances disciplinaires centrales et décentralisées ont contribué au maintien de la sécurité et de l’ordre public dans toute sa résistance, y compris la restriction des droits et libertés, et de souligner le rôle joué par le Président de la République dans le domaine du contrôle administratif au titre des compétences constitutionnelles qui lui sont conférées, outre le rôle des organes de contrôle centraux et décentralisés, les procédures de contrôle administratif dans des situations normales sont soumises à des restrictions ou à des contrôles sur les procédures et les mesures de contrôle administratif en général. Il peut également y avoir des situations exceptionnelles qui justifient l’extension des pouvoirs de l’autorité de contrôle administratif conformément à ces circonstances, à condition que ces organismes soient liés par le principe de légalité.
