In general, possession mortgage is an effective tool to ensure the financing of public transactions and facilitate their implementation, thereby contributing to economic and social development. .................................. الملخص يعد الرهن الحيازي في مجال الصفقات العمومية آلية فعالة لتمويل هذه الصفقات، حيث تلزم عملية تنفيذها توفير الموارد المالية الكافية، و نظرا لاحتياج بعض الجهات إلى خدمات البنوك أو المؤسسات المالية أو صندوق ضمان الصفقات العمومية للحصول على قروض لتمويل تلك الصفقات ، تأتي الحاجة إلى ضمانات تكفل للمقرضين تسديد تلك القروض خلال الفترة بين منحها و حلول أجل استحقاقها ، ولذلك فقد برز الرهن الحيازي كأداة قانونية تتيح للمقرضين البنوك المؤسسات المالية صندوق ضمان الصفقات العمومية حيازة أصول محددة مرتبطة بالصفقة كضمان لوفاء المقترض الإدارة العمومية او الجهة المتعاقدة بالتزاماتها المالية ، وبالتالي تستمد أحكام الرهن الحيازي في الصفقات العمومية من تنظيم الصفقات العمومية مع الاستفادة من أحكام القانون الخاص بهذا النوع من الرهن. بشكل عام يعتبر الرهن الحيازي أداة فعالة لضمان تمويل الصفقات العمومية و تسهيل تنفيذها مما يساهم في تحقيق التنمية الاقتصادية و الاجتماعية . ..................................... En général, l’hypothèque de possession est un outil efficace pour assurer le financement des transactions publiques et faciliter leur mise en œuvre, contribuant ainsi au développement économique et social.
