إشكالات عدم التوافق بين الشريعة والقانون الجزائري حول الطلاق والخلع

Summary Islam began to dismantle the marital bond with the individual will whether for the husband divorce or for the wife a removal of the harme and the Algerian Family Law derived from Islamic law but this law is made of humanity is not without gaps and contradictions on the one hand of its articles amonge themselves and the incompatibility of its rulingson the other hand with Islamic law and these contradiction make individuals fluctuating between the law The Algerian family law with Islamic sharia from which it assumed to be derived so the legislator must reconsider the family Law in a manner commensurate with the muslim community, ................................. الملخص: شرع الإسلام فك الرابطة الزوجية بالإرادة المنفردة، سواء بالنسبة للزوج طلاقا، أو بالنسبة للزوجة خلعا، رفعا للضرر، وقد أقره المشرع في قانون الأسرة الجزائري المستمد من الشريعة الإسلامية، إلا إن هذا القانون من صنع البشر لا يخلو من الثغرات والتناقضات من جهة مواده فيما بينها، وعدم توافق أحكامه من جهة أخرى مع الشريعة الإسلامية، وهذه التناقضات تجعل الأفراد متذبذبين بين أحكام الشريعة و القانون, بهذا يظهر عدم توافق قانون الأسرة الجزائري مع الشريعة الإسلامية التي يفترض انه مستمد منها, فعلى المشرع إعادة النظر في قانون الأسرة بما يتناسب مع مجتمع مسلم، ..............................
