مكانة المجتمع المدني في القانون الجزائري

Abstract

Abstract : The concept of civil society is considered one of the difficult concepts to define as it is a moving concept and in a state of permanent construction, given the status and type of governance prevailing at that stage, as Algeria knew civil society during the colonial period, based on its work in fighting the occupation, and it witnessed development during the period of the eighties in which crises appeared. Economic, social and political, as the state alone was unable to solve these problems, so it directed its attention to civil society, and linked a complementary relationship between them, by granting it a place in its laws, as the Algerian legislator affirmed the right of individuals to form and establish associations, and allocated it to regulatory and constitutional texts to guarantee this right. Civil society has become a complement to the role of the state in various fields due to the effective and prominent role it plays, due to its connection to the social, political, economic and cultural life of individuals. It also plays an effective role in embodying good governance and sustainable development in order to achieve comprehensive and sustainable human development, by combating all negative phenomena. Which affect the development field of the state, such as crimes, corruption, and poverty. All of this has strengthened the position of civil society within the state. ...................... ملخص الدراسة: يعتبر مفهوم المجتمع المدني من المفاهيم صعبة التحديد باعتباره مفهوم متحرك وفي حالة بناء دائم، نظرا لوضعية ونوعية الحكم السائد في تلك المرحلة، حيث عرفت الجزائر المجتمع المدني إبان الفترة الاستعمارية، انطلاقا من عمله في محاربة الاحتلال، وعرف تطورا خلال فترة الثمانينات التي ظهرت بها أزمات اقتصادية واجتماعية وسياسية، حيث عجزت الدولة وحدها عن حل هذه المشاكل، فتوجه اهتمامها بالمجتمع المدني، وربطت علاقة تكامل بينهما، من خلال منحه مكانة في قوانينها، حيث أكد المشرع الجزائري، على حق الأفراد في تكوين وإنشاء الجمعيات، وخصه بنصوص تنظيمية ودستورية لضمان هذا الحق. فأصبح المجتمع المدني مكمل لدور الدولة في مختلف الميادين نظرا للدور الفعال والبارز الذي يقوم به، لارتباطه بالحياة الاجتماعية والسياسية والاقتصادية والثقافية للأفراد، كما يلعب دورا فعالا في تجسيد الحكم الراشد والتنمية المستدامة من أجل تحقيق تنمية بشرية شاملة ومستدامة، وذلك من خلال مكافحة كل الظواهر السلبية التي تؤثر على المجال التنموي للدولة كالجرائم والفساد والفقر، فكل هذا عزز من مكانة المجتمع المدني داخل الدولة. ......................... Résumé : Le concept de société civile est considéré comme l’un des concepts difficiles à définir car il s’agit d’un concept mouvant et en état de construction permanente, compte tenu du statut et du type de gouvernance prévalant à ce stade, l’Algérie connaissant la société civile pendant la période coloniale, Il a été le témoin d’un développement au cours de la période des années 80, au cours de laquelle des crises sont apparues. Économique, social et politique, l’État étant seul incapable de résoudre ces problèmes, il a donc porté son attention sur la société civile, et a lié une relation complémentaire entre eux, en lui accordant une place dans ses lois, comme le législateur algérien a affirmé le droit des individus de former et de fonder des associations, et l’a attribué à des textes réglementaires et constitutionnels pour garantir ce droit. La société civile est devenue un complément au rôle de l’État dans divers domaines en raison de son rôle efficace et important, en raison de son lien avec la vie sociale, politique, économique et culturelle des individus. Il joue également un rôle efficace en incarnant la bonne gouvernance et le développement durable afin de parvenir à un développement humain global et durable, en luttant contre tous les phénomènes négatifs. Qui affectent le domaine de développement de l’État, tels que les crimes, la corruption et la pauvreté. Tout cela a renforcé la position de la société civile au sein de l’État.
