The legislatorsingled the principal of the transparency by authorities and bodies for portrayolitgainst corruption crimes in the public transaction sector. ................................... ملخص : إن الهدف الأساسي الذي تهدف إليه عملية إبرام الصفقات العمومية هو تجسيد المشاريع التنموية المسطرة مسبقا من قبل الدولة، من خلال التسيير الحسن للأموال العامة، وهذا ما دفع المشرع إلى اتخاذ جملة من الإجراءات والمبادئ، ولعل أهمها مبدأ الشفافية والذي يعني توفير المعلومات الضرورية لكافة المتنافسين، حتى تستطيع المصلحة المتعاقدة اختيار المتعامل الذي تتوفر فيه الشروط المناسبة، ويعتبر مبدأ الشفافية أحد مقومات الحكم الراشد، فله أهمية في الحفاظ على المال العام، وأولى له المشرع أهمية بالغة وقد كفلها برقابة سواء كانت إدارية أو قضائيةـ، خص المشرع مبدـأ الشفافية كذلك بسلطات وهيئات تكريسها لمكافحة جرائم الفساد في قطاع الصفقات العمومية. .......................................... Résumé : Le but principal du processus des marchaés public consiste aux projets de développement qui sont pré-gouvernés par l’état. En vu d’assurer l’efficacité de la commande publique et la bonne utilisation des fonds public et le plus important est le principe de transparence ce qui signifie à mettre à la disposition des candidats toutes les informations nécessaire pour pouvoir au maitre de l’ouvrage de bien conduire le partenaire contractant justifiant les conditions nécessaire. Il faut signaler que la transparence l’un des éléments les plus nécessaires pour protéger les fonds public c’est pour cette raison le législateur lui a donné une importance. Elle a été contrôle soit administrativement ou juridiquement sans oublie que le législateur à donner aux les autorités pour contrôler les délits de corruption dans le secteur des marchés public.
