التعويض عن المخاطر الطبيعية في التشريع الجزائري

Abstract

Abstract From what was previously mentioned, natural hazards are sudden events that cannot be anticipated or predicted and have major impacts on all levels. The Algerian legislator defined major hazards in the law on disaster prevention and management within the framework of sustainable development as a potential threat to humans and the environment that may occur as a result of an exceptional natural emergency or as a result of human activity. The state's legal responsibility for its responsibility toward those affected is based on the presence of a set of elements: harm, the act of a third party, and a causal relationship between the harmful act and the state's or its employees' control. However, the harmful act is caused by force majeure, which neither party can prevent. Therefore, the Algerian state has developed a set of legal texts regulating the compensation process and assigning compensation tasks to specialized entities. The legislator stipulated the obligation of natural hazard insurance, and this contract stipulated a set of conditions specific to it, as it is an insurance contract specifically for natural hazards. .......................... مما سبق ذكره أن المخاطر الطبيعية عبارة عن حادثة فجائية لا يمكن توقعها أو التنبؤ بحدوثها وتخلف آثار كبيرة على جميع الأصعدة حيث عرف المشرع الجزائري المخاطر الكبرى في القانون بالوقاية من الكوارث وتسيرها في إطار التنمية المستدامة بأنها تهديد محتمل للإنسان والبيئة قد يحدث بفعل طارئ طبيعي استثنائي أو بفعل نشاط الإنسان. وتقوم المسؤولية القانونية للدولة في تحمل مسؤوليتها تجاه المتضررين بتوفر مجموعة من الأركان من ضرر والفعل الصادر من الغير والعلاقة السببية بين الفعل الضار الخارج عن إرادة الدولة أو مستخدميها وإنما بفعل القوة القاهرة لا يقوى الطرفين على درئها، لذلك عملت الدولة الجزائرية على وضع مجموعة من النصوص القانونية التي تنظم عملية التعويض وكذلك إسناد مهام التعويض لجهات متخصصة. ونص المشرع على إلزامية التأمين ضد المخاطر الطبيعية وهذا العقد اشترط فيه مجموعة من الشروط الخاصة به باعتباره عقد تأمين خاض فقط بالمخاطر الطبيعية. .......................... Résumé Comme mentionné précédemment, les risques naturels sont des événements soudains et imprévisibles qui ont des répercussions importantes à tous les niveaux. Le législateur algérien a défini les risques majeurs dans la loi relative à la prévention et à la gestion des catastrophes, dans le cadre du développement durable, comme une menace potentielle pour l'homme et l'environnement pouvant survenir à la suite d'une catastrophe naturelle exceptionnelle ou d'une activité humaine. La responsabilité juridique de l'État envers les personnes touchées repose sur la présence d'un ensemble d'éléments : un préjudice, l'action d'un tiers et un lien de causalité entre l'acte dommageable et le caractère incontrôlé de l'État ou de ses agents. Cependant, l'acte dommageable n'est pas dû à un cas de force majeure, que les deux parties ne peuvent empêcher. C'est pourquoi l'État algérien a élaboré un ensemble de textes juridiques régissant le processus d'indemnisation et confiant les tâches d'indemnisation à des entités spécialisées. Le législateur a stipulé le caractère obligatoire de l'assurance, et ce contrat a stipulé un ensemble de conditions qui lui sont propres, puisqu'il s'agit d'un contrat d'assurance spécifiquement destiné aux risques naturels.
