Abstract

Summary As a result of the circumstances experienced by Algeria as a result of the financial crisis of the 1980s, a new pattern was needed, especially after the decline in petroleum habits, which was and remains the cornerstone of Algeria's economy. s economic system through the creation of several independent administrative bodies to ensure that the economic sector is conducted in an optimal manner, especially after global developments in this area and the globalization of international economic relations. The State's withdrawal from the economic sphere has never been demonstrated by its retention of the function of monitoring itself through the judiciary, which is the judiciary, in order to ensure that these bodies do not arbitrarily exercise their powers. ...................... مـلخـــــــــــــــــــــــــــص نتيجة للظروف التي عانت منها الجزائر جراء الأزمة المالية في فترة الثمانينات أوجب التوجه إلى نمط جديد خاصة بعد انخفاض عادات البترول الذي كان و لازال الركيزة الأساسية التي يقوم عليها الاقتصاد الجزائري، مما دفع بالدولة لانتهاج أسلوب الضبط من خلال انسحابها من الحقل الاقتصادي و تبنيها لنظام اقتصاد السوق عن طريق استحداث عدة هيئات إدارية مستقلة تضمن لها تسيير القطاع الاقتصادي بطريقة مثلى خاصة بعد التطوارت العالمية في هذا المجال و ما أقرته العولمة من انفتاح في العلاقات الاقتصادية الدولية. إن انسحاب الدولة من الحقل الاقتصادي لم يكن مطلقا و يظهر ذلك من خلال احتفاظها بمهمة الرقابة لنفسها عن طريق الجهاز القضائي متمثلة في السلطة القضائية لضمان عدم تعسف هذه الهيئات في ممارسة الاختصاصات المخولة لها. ......................... Résumé En raison des circonstances vécues par l’Algérie à la suite de la crise financière des années 1980, un nouveau schéma était nécessaire, surtout après le déclin des habitudes pétrolières, qui était et reste la pierre angulaire de l’économie algérienne. Le système économique de l’Union européenne, par la création de plusieurs organes administratifs indépendants pour assurer que le secteur économique est conduit de manière optimale, en particulier après les développements mondiaux dans ce domaine et la mondialisation des relations économiques internationales. Le retrait de l’État de la sphère économique n’a jamais été démontré par le maintien de la fonction de contrôle par le pouvoir judiciaire, c’est-à-dire le pouvoir judiciaire, afin de s’assurer que ces organes n’exercent pas arbitrairement leurs pouvoirs.
