Abstract

Abstract In light of the rapid technological advancements witnessed globally—particularly in the military sphere—the nature of armed conflicts has significantly evolved in recent years. Warfare has shifted from relying primarily on human involvement to the increasing deployment of autonomous systems, commonly referred to as "autonomous weapons." Given the ongoing controversy surrounding the classification and use of such weapons, states and international organizations have recently shown heightened interest in the matter. This topic is now the subject of intense international debate, focusing on the potential challenges these systems pose to the framework of international humanitarian law. This study seeks to examine the position of international humanitarian law (IHL) regarding autonomous weapon systems (AWS). It explores the concept, characteristics, and classifications of autonomous weapons, and analyzes the implications of their use in armed conflicts. The research further investigates the extent to which these weapons comply with the fundamental principles of IHL. Ultimately, the study addresses the question of accountability for the deployment of such systems in contemporary international and non-international armed conflicts. The paper concludes with a summary of key findings and offers practical recommendations. ............................... الملخص نظرا للتطور التكنولوجي المتسارع الذي يشهده العالم اليوم والذي شمل جميع المجالات وخاصة المجال العسكري، حيث تغيرت أساليب النزاعات المسلحة في السنوات الأخيرة، حيث انتقلت من مشاركة العنصر البشري إلى مشاركة الآلة والتي يطلق عليها اسم "السلاح الذاتي". ونظرا للجدل القائم حول نوع هذا السلاح فقد أبدت الدول والمنظمات الدولية في الآونة الأخيرة عناية خاصة بها إذ تتم مناقشة هذا الموضوع بشدة على الساحة الدولية لمعرفة التحديات المحتملة التي يطرحها استخدام هذه الأنظمة على صعيد القانون الدولي الإنساني. تهدف هذه الدراسة إلى التعرف على موقف القانون الدولي الإنساني من الأسلحة ذاتية التشغيل، وذلك من خلال بيان ماهية الأسلحة ذاتية التشغيل، وخصائصها وأنواعها، بالإضافة إلى أثر استخدامها في النزاعات المسلحة ومن ثم التركيز على مدى توافق هذه الأسلحة مع مبادئ القانون الدولي الإنساني، وتنتهي في نهاية المطاف إلى التطرق لمسألة المسؤولية عن مشاركة هذه الأنظمة في النزاعات التي تحدث على صعيد المجتمع الدولي، ومن ثم خاتمة تتضمن أهم الاستنتاجات والاقتراحات. ............................. Résumé Les avancées technologiques rapides – en particulier dans le domaine militaire – ont profondément transformé la nature des conflits armés ces dernières années. La guerre moderne se caractérise de plus en plus par le déploiement de systèmes autonomes, communément appelés systèmes d’armes autonomes (SAA), réduisant l’implication directe de l’humain sur le champ de bataille. La classification, la régulation et l’usage éthique de ces systèmes sont désormais au cœur des débats internationaux contemporains, notamment en ce qui concerne leur compatibilité avec les principes du droit international humanitaire (DIH). Cette étude examine la position juridique du DIH à l’égard des SAA. Elle explore les définitions, les caractéristiques et les classifications de ces armes autonomes, et analyse leurs implications pour la conduite des hostilités. La recherche évalue également dans quelle mesure ces systèmes respectent les principes fondamentaux du DIH, tels que la distinction, la proportionnalité et la précaution. En outre, elle aborde la question de la responsabilité en cas de déploiement ou de mauvaise utilisation de ces systèmes dans les conflits armés internationaux et non internationaux. L’article se conclut par une synthèse des résultats clés et propose des recommandations concrètes pour renforcer les cadres juridiques et politiques.
