Abstract

Abstract: Through this memorandum, we tried to address the constitutive act of the African Union, its content and objectives, which it seeks to protect human and peoples' rights in accordance with the African Charter on Human and People's rights, and to address the challenges and principals that it set and its organs, whether administrative, economic, social or cultural such as the conference of the supreme organ and the executive council, the specific and specialized committees, the Pan-African parliament, and the council for international peace and security, which aim to strong then international peace and security and prevent conflicts on the African continent, in addition to the rights guaranteed in the African constitution, including what are political and civil and forbidding what are cultural, economic and social and in order to protect the rights too mechanisms have been embodied in the African commission on Human and People's rights, which is a quasi-judicial mechanism which undertakes the task of ensuring the pauper implementation by States of their obligations and to make room for victims whose rights are violated and to complain before them, and on this basis it seeks to protect and promote human rights on the African continent. ......................... ملخص حاولنا من خلال هذه المذكرة التطرق إلى القانون التأسيسي للإتحاد الإفريقي مضمونه أهدافه التي يسعى إليها، و هي حماية حقوق الإنسان والشعوب طبقا للميثاق الإفريقي، والتطرق لتحديات والمبادئ التي وضعها، وأجهزته سواء كانت إدارية أو اقتصادية والاجتماعية والثقافية، كمؤتمر الجهاز الأعلى والمجلس التنفيذي واللجان العينية المتخصصة، وبرلمان عموم إفريقيا ومجلس السلم والأمن الدوليين و اللتان تهدفان إلى تعزيز السلم والأمن الدوليين، ومنع النزاعات في القارة الإفريقية، إضافة إلى الحقوق المكفولة في الميثاق الإفريقي منها ما هي سياسية ومدنية ومنها ما هي ثقافية واقتصادية واجتماعية، ومن أجل حماية هذه الحقوق تم إنشاء آليتين لتعزيز وحماية هذه الحقوق في الميثاق الإفريقي لحقوق الإنسان والشعوب، وتجسدت هذه الآلية في اللجنة الإفريقية لحقوق الإنسان والشعوب، وهي آلية شبه قضائية، بالإضافة إلى إنشاء آلية قضائية بموجب البروتوكول الخاص المضاف للميثاق الإفريقي وتتمثل في المحكمة الإفريقية لحقوق الإنسان والشعوب، والتي تتولى مهمة السهر على حسن تنفيذ الدول لالتزاماتهم، ولإفساح المجال أمام الضحايا المنهكة حقوقهم والتظلم أمامها، والتي تسعى على هذا الأساس لحماية وتعزيز حقوق الإنسان في القارة الإفريقية. ........................... Résumé Par ce mémorandum, nous avons essayé de traiter l’Acte constitutif de l’Union africaine avec ses objectifs. la protection des droits de l’homme et des peuples conformément à la Charte africaine et la réponse aux défis et aux principes qu’elle a développés et à ses organes, administratifs ou économiques, sociaux et culturels, tels que la Conférence de l’Organe suprême, le Conseil exécutif et les comités spécialisés en nature du Parlement panafricain et du Conseil pour la paix et la sécurité internationales, qui visent à renforcer la paix et la sécurité internationales, à prévenir les conflits sur le continent africain, en plus des droits garantis par la Charte africaine, y compris les questions politiques, civiles, culturelles, économiques et sociales; Afin de protéger ces droits, deux mécanismes de promotion et de protection de ces droits ont été établis dans la Charte africaine des droits de l’homme et des peuples Ce mécanisme a été incorporé dans la Commission africaine des droits de l’homme et des peuples, un mécanisme quasi judiciaire en plus d’établir un mécanisme judiciaire en vertu du Protocole spécial à la Charte africaine des droits de l’homme et des peuples, qui est chargé de veiller à ce que les obligations des États soient correctement mises en œuvre et de permettre aux victimes dont les droits ont été violés et de porter plainte devant eux, Il vise à protéger et promouvoir les droits de l’homme sur le continent africain
