حدود حرية الاستثمار في التشريع الجزائري

Abstract

Summary: The Algerian State has devoted all efforts to creating an environment conducive to attracting investments through the principle of freedom of investment, but it is not an effective or absolute freedom. in order for the legislator to set a range of boundaries against investors, especially foreigners alike, Whether it relates to the area of activity, namely, the rationed activities, environmental protection and subsequent actions that impede the investment project and these boundaries have touched all stages of the project's completion phase by committing investors to a set of commitments, Besides subjecting them to discriminatory treatment within the framework of the partnership in order to reach the liquidation phase by determining the right of the State and controlling the exchange and the movement of capital. That limited the freedom of investment, which was the most important incentive to attract investments and attract the desired capital to drive Algeria's development and support economic development. ................. الملخص : كرست الدولة الجزائرية كل الجهود في سبيل خلق المناخ الملائم لاستقطاب الاستثمارات من خلال مبدأ حرية الاستثمار الا انها ليست حرية فعلية او مطلقة، بحيث وضع المشرع مجموعة من الحدود في مواجهة المستثمرين خاصة الأجانب منهم سواء، سواءا فيما تعلق بمجال النشاط والمتمثل في كل من النشاطات المقننة وحماية البيئة وما تبعه من إجراءات معرقلة للمشروع الاستثماري ، ومست هذه الحدود كل مراحل المشروع من مرحلة إنجازه بالزام المستثمرين بمجموعة من الالتزامات، الى جانب اخضاعهم للمعاملة التمييزية في اطار الشراكة وصولا لمرحلة التصفية بتقرير حق الشفعة للدولة و الرقابة على الصرف وحركة رؤوس الأموال. وذلك ما يحد من حرية الاستثمار التي تعد اهم حافز لجذب الاستثمارات واستقطاب رؤوس الأموال المرغوبة لتحريك عجلة التنمية في الجزائر ودعم التطور الاقتصادي. ...................... Résumé : L’Etat algérien a consacré tous ses efforts à créer un environnement propice à attirer les investissements par le principe de la liberté d’investissement, mais ce n’est pas une liberté effective ou absolue. afin que le législateur établisse une série de limites contre les investisseurs, en particulier les étrangers, qu’il s’agisse du domaine d’activité, à savoir les activités rationnées, la protection de l’environnement et les actions ultérieures qui entravent le projet d’investissement et ces limites ont touché toutes les étapes de la phase d’achèvement du projet en engageant les investisseurs à un ensemble d’engagements, En plus de les soumettre à un traitement discriminatoire dans le cadre du partenariat afin d’atteindre la phase de liquidation en déterminant le droit de l’État et en contrôlant l’échange et la circulation des capitaux. Cela a limité la liberté d’investissement, qui était l’incitatif le plus important pour attirer les investissements et attirer le capital désiré pour stimuler le développement de l’Algérie et soutenir le développement économique.
