الفضاءات التجارية في التشريع الجزائري

Abstract

Summary: This research addresses the subject of commercial spaces in Algerian legislation, as regulated by Executive Decree No. 12-111, which sets out the conditions and conditions for the establishment and regulation of commercial spaces and the exercise of certain commercial activities. It was clear that Algeria's legislature had singled out these spaces for a number of provisions concerning the establishment, management, inspection and censorship of activities within it. in order to achieve a policy of market openness and encourage the private sector to enter business life in a legally orderly and controlled manner. ............................. الملخص: يعالج هذا البحث موضوع الفضاءات التجارية في التشريع الجزائري، وذلك وفق ما تم تنظيمه بموجب المرسوم التنفيذي رقم 12-111 الذي يحدد شروط وكيفيات إنشاء وتنظيم الفضاءات التجارية وممارسة بعض الأنشطة التجارية، وإتضح أن المشرع الجزائري قد خص هذه الفضاءات بعدد من الأحكام فيما يتعلق بالإنشاء والتسيير والمعاينة والرقابة سعيا منه لضبط النشاطات الممارسة بداخلها، وسعيا منه لتحقيق سياسة الإنفتاح على السوق وتشجيع القطاع الخاص على دخول الحياة التجارية لكن بشكل منظم ومضبوط من الناحية القانونية . ......................... Résumé : Cette recherche aborde le sujet des espaces commerciaux dans la législation algérienne, tel que réglementé par le décret exécutif n. 12-111, qui établit les conditions et conditions pour l’établissement et la réglementation des espaces commerciaux et l’exercice de certaines activités commerciales. Il était clair que le législateur algérien avait choisi ces espaces pour un certain nombre de dispositions concernant l’établissement, la gestion, l’inspection et la censure des activités à l’intérieur. afin de parvenir à une politique d’ouverture du marché et d’encourager le secteur privé à entrer dans la vie des affaires de manière ordonnée et contrôlée par la loi.
