Abstract

Summary: Our systematic examination of the safeguards of the principle of the regular functioning of the public facility has made us say that such safeguards are crucial in maintaining the continuity of the provision of such facilities as the fundamental pillar of the State's pursuit of the various elements of the public interest. In order to protect the public facility on the one hand and its clients on the other hand, legislative guarantees are the regulation of the exercise of the right to strike as well as the right to resign in addition to the protection of public property, while judicial guarantees are reflected in the theory of emergency circumstances and the actual employee. ............................. الملخص : إن دراستنا لموضوع ضمانات مبدأ سير المرفق العمومي بانتظام واطرد جعلتنا نقول أن هذه الضمانات تكتسي أهمية بالغة في الحفاظ على استمرارية تقديم تلك المرافق لخدماتها باعتبارها الركيزة الأساسية في الدولة التي تسعى وراء تحقيق المصلحة العامة بمختلف عناصرها،إذ وجب إحاطة هذا المبدأ بجملة من الضمانات منها التشريعية ومنها القضائية قصد حماية المرفق العمومي من جهة والمتعاملين معه من جهة أخرى، أما الضمانات التشريعية فتتمثل في تنظيم ممارسة حق الإضراب وكذا حق الإستقالة بالإضافة إلى حماية المال العام، بينما تتجلى الضمانات القضائية في نظريتي الظروف الطارئة والموظف الفعلي. ........................ Résumé : Notre examen systématique des garanties du principe de fonctionnement régulier de l’établissement public nous a amenés à dire que ces garanties sont cruciales pour maintenir la continuité de la fourniture de tels établissements comme pilier fondamental de la poursuite de l’État divers éléments d’intérêt public. Afin de protéger l’établissement public d’une part et ses clients d’autre part, les garanties législatives sont la réglementation de l’exercice du droit de grève ainsi que le droit de démissionner en plus de la protection des biens publics, Les garanties judiciaires se reflètent dans la théorie des circonstances d’urgence et de l’employé réel.
