Abstract

Abstract : The Constitution of 2020 was promulgated as a qualitative leap to build a new Algeria that is based on the principles of real democracy and participation in decision-making, so the constitutional founder worked to create a group of constitutional advisory bodies, including the Supreme Council for Youth, and as it is known that it is one of the basic ingredients for creating a favorable ground for youth participation in building the country and its advancement It is the existence of a legal framework that suits young people and encourages them to engage in the consultative process, and this prompted the President of the Republic to create this council. And the integration of youth in building the country and its advancement, especially after the movement of February 22, 2019, as well as clarifying its formation and work mechanisms in accordance with Presidential Decree No. 21/416, as well as Presidential Decree No. 23/58 that defines its income system. ..................... - الملخص : صدر دستور2020 كقفزة نوعية لبناء الجزائر الجديدة التي تقوم على مبادئ الديموقراطية الحقيقية والمشاركة في اتخاذ القرارات ،لذلك عمل المؤسس الدستوري الى إحداث مجموعة من الهيئات الدستورية الاستشارية منها المجلس الأعلى للشباب،وكما هو معروف أن من المقومات الأساسية لخلق أرضية مواتية لمشاركة الشباب في بناء الوطن ورقيه هو وجود إطار قانوني يلائم الشباب ويشجعهم على الانخراط في العملية الاستشارية وهذا ما دفع برئيس الجمهورية لاستحداث هذا المجلس، حيث حاولنا من خلال هذه الدراسة تقصي الإطار القانوني الذي ينظم هذا المجلس باعتباره إطارا مؤسساتيا يعبر عن الأهمية البالغة التي تحظى بها فئة الشباب في الجزائر ويهدف لدفاع عنها ودمج الشباب في بناء الوطن ورقيه، لاسيما بعد حراك 22 فيفري 2019، وكذا توضيح تشكيلته وآليات عمله وفق المرسوم الرئاسي رقم 21/ 416 وكذا المرسوم الرئاسي رقم 23/58 الذي يحدد نظامه الداخلي. ...................

Résume : La Constitution de 2020 a été promulguée comme un saut qualitatif pour construire une nouvelle Algérie fondée sur les principes d'une démocratie réelle et de la participation à la prise de décision. Le fondateur de la Constitution a donc travaillé à la création d'un groupe d'organes consultatifs constitutionnels, dont le Conseil suprême de la jeunesse, et comme on sait qu'elle est l'un des ingrédients de base pour créer un terrain favorable à la participation des jeunes à la construction du pays et à son progrès. C'est l'existence d'un cadre juridique qui convient aux jeunes et les encourage à s'engager dans le processus consultatif. processus, ce qui a incité le Président de la République à créer ce conseil.
