Abstract

Abstract : This research deals with an issue of Islamic jurisprudence and Algerian family law, the issue of the methods and controls for protecting the testament through its conditions, deals with the testator, the legatee and the recommended who is the subject of the testament , As well as protecting her from a fictitious testament and its consequences, this study also deals with the methods of executing the testament , as well as how to prove it and the procedures for publicizing it within the scope of civil law and real estate registration laws, The research also moves to the opinion of the rewarding and preventative jurists in the texts of this topic. .................. الملخص: يتناول هذا البحث قضية من قضايا الفقه الإسلامي وقانون الأسرة الجزائري، ويعالج موضوع طرق وضوابط حماية الوصية من خلال شروطها، كل من الموصى والموصـى لـه والموصى به الذي يتمثل في محل الوصية ، وكذلك حمايتها من الوصية الصورية وما يترتب عنها، وكذلك تتناول هذه الدراسة طرق تنفيذ الوصية وكذلك كيفية إثباتها وإجراءات شهرها في نطاق القانون المدني وقوانين الشهر العقاري ، كما ينتقل البحث إلى رأي الفقهاء المجزين والمانعين في نصوص هذا الموضوع. ............... Résumé : Cette recherche aborde une question de jurisprudence islamique et de droit de la famille algérien, et aborde le sujet de Méthodes et contrôles pour la protection de la volonté à travers ses termes, à la fois le tuteur recommandé et recommandé qui est le lieu de la volonté, ainsi que sa protection contre la fausse volonté et ses conséquences.
