Abstract

Summary: ILO is one of the most important specialized agencies of a social nature dealing with workers' rights with special emphasis on vulnerable groups, including foreign workers. To this end, it has adopted a wide range of conventions and recommendations. The Convention on Migrant Workers, Freedom of Association, Abolition of Forced Labour, Freedom from Discrimination in Employment, Occupation and Others. It has also established procedures for monitoring and supervising the implementation of these conventions. This is a specialized organ operating independently of States, to determine the compatibility of measures taken at the national level with the provisions of the Organization's conventions and to identify the difficulties and obstacles that prevent States from implementing these conventions. The graduation note entitled "International protection of foreign employment" addressed this topic at some length by dealing with the following problems: if ILO is concerned with social justice and human rights, and has established a basis for attention to labour and workers' problems, has it succeeded in protecting the rights of foreign workers? Based on the above Work Section in two chapters: Chapter I: Identifying the idea of foreign employment and mechanisms for organizing its work Chapter II: International standards governing foreign workers' rights and ways of protecting them .............................. ملخص : تعتبر منظمة العمل الدولية من أهم الوكالات المتخصصة ذات الطابع الإجتماعي التي تعنى بحقوق العمال مع التركيز بشكل خاص على الفئات الضعيفة و منها العمال الأجانب ومن أجل ذلك فقد تبنت مجموعة كبيرة من الإتفاقيات و التوصيات ، من أهمها الإتفاقية الخاصة بالعمال المهاجرين ،الحرية النقابية ، إلغاء العمل الجبري ، التحرر من التمييز في الإستخدام و المهنة وغيرها . كما وضعت إجراءات خاصة بالرقابة و الإشراف على تنفيذ هذه الإتفاقيات ،وتتولى ذلك أجهزة متخصصة تعمل بإستقلال عن الدول ، لمعرفة مدى ملاءمة التدابير المتخذة على الصعيد الوطني مع الأحكام المنصوص عليها في إتفاقيات المنظمة و الوقوف على الصعوبات و العراقيل التي تحول دون تنفيذ الدول لهذه الإتفاقيات. وقد تناولت مذكرة التخرج المعنونة ب '' الحماية الدولية للعمالة الأجنبية'' هذا الموضوع بشيء من الإسهاب وذلك عن طريق التعاطي مع الإشكالية التالية: إذا كانت منظمة العمل الدولية تعني بالعدالة الاجتماعية وحقوق الإنسان, وأنها أنشأت أساسا من أجل الاهتمام بمشاكل العمل والعمال ،فهل نجحت في حماية حقوق العمال الأجانب؟ بناء على ما تقدم قسم العمل إلى فصلين: الفصل الأول: تحديد فكرة العمالة الأجنبية و آليات تنظيم عملها الفصل الثاني : المعايير الدولية الضابطة لحقوق العمال الأجانب و سبل حمايتها ......................... Résumé : L’OIT est l’une des plus importantes institutions spécialisées de nature sociale qui s’occupent des droits des travailleurs, avec un accent particulier sur les groupes vulnérables, y compris les travailleurs étrangers. À cette fin, il a adopté un large éventail de conventions et de recommandations. La Convention sur les travailleurs migrants, la liberté d’association, l’abolition du travail forcé, l’absence de discrimination dans l’emploi, la profession et autres. Il a également établi des procédures de suivi et de supervision de la mise en œuvre de ces conventions. Il s’agit d’un organe spécialisé fonctionnant indépendamment des États, déterminer la compatibilité des mesures prises au niveau national avec les dispositions des conventions de l’Organisation et identifier les difficultés et les obstacles qui empêchent les États de mettre en œuvre ces conventions. La note de fin d’études intitulée "Protection internationale de l’emploi à l’étranger" a abordé ce sujet dans une certaine mesure en abordant les problèmes suivants : si l’OIT s’intéresse à la justice sociale et aux droits de l’homme, A-t-il réussi à protéger les droits des travailleurs étrangers? Basé sur la section de travail ci-dessus en deux chapitres : Chapitre I : Identifier l’idée de l’emploi étranger et les mécanismes d’organisation de son travail Chapitre II : Normes internationales régissant les droits des travailleurs étrangers et les moyens de les protéger
