التعاون الدولي لمكافحة الفساد الإداري

Abstract

ملخص: إن موضوع التعاون الدولي من أجل مكافحة الفساد الإداري أصبح موضوع هام للغاية حيث تم تسليط الضوء عليه من طرف الباحثين سواء في مجال العلوم السياسية وحتى العلوم الاجتماعية في كل دول العالم تقريبا، وذلك للحد والردع عن هذه الجريمة العابرة للحدود والاقتصاد الدولي. وهذا ما أدى بالدول الأوروبية والعربية لتكاثف الجهود فيما بينها من أجل إنشاء منظمات دولية وإقليمية وكذلك مصادقة اتفاقيات دولية وإقليمية من أجل مكافحة الفساد وبروتوكولات إضافية من أجل وضع حد لهذه الجريمة والردع عنها. وكانت الجزائر حاضرة وبقوة في هذه الاتفاقيات حيث صادقت على العديد من الاتفاقيات كاتفاقية الأمم المتحدة لمكافحة الفساد الإداري وكذلك صادقت على الاتفاقية العربية. حيث اعتمد المشرع الجزائري في هذا الموضوع على إنشاء هيئات وطنية مختصة في ه\ا المجال كالهيئة الوطنية للوقاية من الفساد ومكافحته التي تضمنها القانون رقم 06-01 المتعلق بالوقاية من الفساد ومكافحته حيث تضمن هذا القانون إجراءات المتابعة القضائية وكذلك إعادة تنظيم بعض القواعد العامة واستحداث أساليب تحري خاصة. ................... Abstract : The subject of international cooperation to combat administrative corruption has become a very important topic, as it has been highlighted by researchers, both in the field of political science and even social sciences, in almost all countries of the world, in order to limit and deter this cross-border crime and the international economy. This has led European and Arab countries to intensify their efforts to establish international and regional organizations, as well as ratify international and regional agreements to combat corruption and additional protocols to put an end to this crime and deter it. Algeria was strongly present in these conventions, as it ratified many conventions, such as the United Nations Convention against Administrative Corruption, as well as the Arab Convention. In this regard, the Algerian legislator relied on the establishment of national bodies specialized in this field, such as the National Authority for the Prevention and Control of Corruption, which was included in Law No. 06-01 related to the prevention and control of corruption, as this law included judicial follow-up procedures as well as the reorganization of some general rules and the development of methods Private investigation. ..................... Résumé : Le sujet de la coopération internationale pour lutter contre la corruption administrative est devenu un sujet très important, comme l'ont souligné des chercheurs, tant dans le domaine des sciences politiques que des sciences sociales, dans presque tous les pays du monde, afin de limiter et de dissuader cette criminalité transfrontalière et l'économie internationale. Cela a conduit les pays européens et arabes à intensifier leurs efforts pour créer des organisations internationales et régionales, ainsi qu'à ratifier des accords internationaux et régionaux pour lutter contre la corruption et des protocoles additionnels pour mettre fin à ce crime et le dissuader. L'Algérie était fortement présente dans ces conventions, puisqu'elle a ratifié de nombreuses conventions, telles que la Convention des Nations Unies contre la corruption administrative, ainsi que la Convention arabe. A cet égard, le législateur algérien s'est appuyé sur la création d'organismes nationaux spécialisés dans ce domaine, comme l'Autorité nationale de prévention et de contrôle de la corruption, prévue dans la loi n° 06-01 relative à la prévention et au contrôle de la corruption, car cette loi prévoyait des procédures de suivi judiciaire ainsi que la réorganisation de certaines règles générales et le développement des méthodes d'enquête privée.
