Abstract

Abstract: The prevailing belief among most jurists is that humanitarian principles have become the cornerstone of all rules of international humanitarian law (IHL), such that any violation of any rule of the latter constitutes, in one way or another, a breach of humanitarian principles and a violation of humanitarianism itself. Protecting humanitarian principles is a shared responsibility that falls on all parties involved, including states, armed groups, international and local organizations, non-governmental organizations, and civil society. The development of new, comprehensive mechanisms is an imperative. The recent Gaza War, which began in October 2023, has exposed the inadequacy of existing mechanisms to effectively and impartially apply humanitarian principles as enshrined in the rules of IHL and the arsenal of conventions related to the humanization of warfare and human rights. This calls for an urgent review of these agreements, which are on the verge of becoming obsolete in regulating new forms of conflicts that are entirely different from the traditional forms they were designed to govern, in terms of the methods and means used during them. Résumé: La conviction dominante parmi la plupart des juristes est que les principes humanitaires sont devenus la pierre angulaire de toutes les règles du droit international humanitaire (DIH). Ainsi, toute violation d'une quelconque règle de ce dernier constitue, d'une manière ou d'une autre, une atteinte aux principes humanitaires et une violation de l'humanitarisme lui-même. La protection des principes humanitaires est une responsabilité partagée qui incombe à toutes les parties concernées, y compris les États, les groupes armés, les organisations internationales et locales, les organisations non gouvernementales et la société civile. Le développement de nouveaux mécanismes complets est un impératif. La récente guerre de Gaza, qui a débuté en octobre 2023, a mis en évidence l'inadéquation des mécanismes existants pour appliquer efficacement et impartialement les principes humanitaires tels qu'ils sont inscrits dans les règles du DIH et dans l'arsenal des conventions relatives à l'humanisation de la guerre et aux droits de l'homme.
