Abstract

Summary: The inclusion of the mediation system as an alternative means of resolving disputes in general and administrative disputes in particular within Algeria's legal system is undoubtedly a qualitative leap in the reform of the Algerian judiciary and, in particular, the administrative justice system. It will help to resolve these conflicts promptly and confidentially while ensuring that the trust between the public administration and the individual remains. ................................... الملخص: لا شك أن إدراج نظام الوساطة كإحدى الطرق البديلة لحل النزاعات بصورة عامة والنزاعات الإدارية بصفة خاصة، ضمن المنظومة القانونية الجزائرية يشكل قفزة نوعية في مسار إصلاح القضاء الجزائري و بالأخص القضاء الإداري، إذ أنها كفيلة بحل هذه النزاعات بشكل سريع و سري مع ضمان استمرار الثقة القائمة بين الإدارة العامة واألفراد. ................................ Résumé : L’inclusion du système de médiation comme moyen alternatif de règlement des litiges en général et des contentieux administratifs en particulier dans le système juridique algérien est sans aucun doute un saut qualitatif dans la réforme de la justice algérienne et, en particulier, le système de justice administrative. Il aidera à résoudre ces conflits rapidement et de façon confidentielle tout en veillant à ce que la confiance entre l’administration publique et le particulier demeure.
